SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF FEBRUARY 15, 1984
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-60-84 and the minutes of the
Committee of Adjustment meeting of February 15,
1984 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of February 15, 1984. This list includes the file
number, applicant's name, site location, type of variance
requested, staff 's comments on the applications, and the
Committee of Adjustment' s decision.

APPLICATIONS:
A 5/84 - CRAIG K & LAURIE L. I. GREENTREE, Part Lot 12, Conc. 2, Bowmanville
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot having a
frontage of 46.3 ft. , instead of the requried 50 ft. frontage with an
existing single family dwelling having a side yard of 2.5 ft. ( .76 m) ,
instead of the required 1 .25 m side yard.
Mr. K. Van Nest appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne seconded by Mr. Muir,
THAT as this variance would not offend the intent
of the Official Plan or Zoning By-law and as the
variance is minor in nature and would recognize the
existing non-conformities, permission is GRANTED to
continue the use of a lot with a frontage of 46.3 ft.
and an existing single family dwelling having a side
yard of 2.5 ft. "

A 6/84 - Catherine & James Isbister, Lot 32, Concession 7, Clarke.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an additional storey over
a portion of the existing single family dwelling, maintaining the
existing legal non-conforming set back, a front yard of 42 feet and
side yard of 12 feet, instead of the required 25.3 m (83 ft. ) set
back, 50 ft. front yard and 25 ft. side yard.
No person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Yellowlees,
"THAT as the variance is in keeping with the intent
of the zoning By-law and Official Plan and could be
considered minor in nature as the addition will not
encroach further into the non-conforming yard, per-
mission is GRANTED to construct an additional storey
over a portion of the existing single family dwelling
maintaining the existing non-conforming yards. Per-
mission is also GRANTED to continue the use of a
garage located in the side yard less than 3.0 m from
the main building."

A 7/84 - David D. Lawson, Lot 12, B. F. Concession, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a foundation and new roof
to the existing single family dwelling, maintaining the existing non-
conforming 4 ft. side yard, instead of the required 6 m (20 ft. )
side yards.
Mr. Lawson appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Rehder, seconded by Mr. Murdoch,
"THAT as the variance is in keeping with the intent
of the Zoning By-law and Official Plan and is minor
in nature as the construction will not encroach further
into the non-conforming yard, permission is GRANTED
to construct a foundation and new roof maintaining a
side yard of 4 feet. This approval is conditional
upon written confirmation from the Ministry of the
Environment and Durham Regional Health Unit. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a covered entrance over
the existing steps, maintaining the existing yards.
Mr. Wallace Boughen appeared in support of this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mrs. Payne, seconded by Mr. Reicheld,
"THAT as the requested variance would not offend the
intent of the Zoning By-law or Official Plan and as
the variance would not appear to have a detrimental
effect on the abutting properites, the variance is
considered minor in nature and permission is GRANTED
to construct a covered entrance over the existing
steps thereby maintaining the existing non-conforming
yards. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage of
41 .5 m, instead of the required 100.6 m frontage.
Mr. Forrest appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
THAT as the requested variance would be in keeping
with the intent of the Official Plan and Zoning By-
law, permission is GRANTED to the applicant to
create a lot having a frontage of 41 .5 m, instead
of the required 100.6 m frontage. This variance
is considered minor in nature and should not have
a detrimental effect on the continued operation
of the farm land. "

Moved by Mrs. Payne, seconded by Mr. Yellowlees,
"That application No. A 12/84 filed by Fred and Michelle
Rypstra be deferred to the next meeting of the Committee
in order that someone can be present to answer questions
with respect of this variance. "

Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT the minutes of the last meeting be approved as
circulated. "

Appeal date for the foregoing applications is March 15, 1984
