DOCIMO PART LOT 19, CONCESSION 2, DARLINGTON FILE NO. : DEU 83-41 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-61 -84 be received; and * 2. That the attached by-law to amend Zoning By-law 2.111 , as amended, in respect of Part Lot 19, Concession 2, former Township of Darlington be approved. . . .2_ e�� I REPORT NO. : PD-61-84 Page 2 BACKGROUND: On December 20, 1983, the Planning Department received an application submitted by D.G. Biddle and Associates on behalf of Mr. F. Docimo to rezone a 1306 square metre parcel of land in Part of Lot 19, Concession 2, former Township of Darlington. The purpose of the rezoning would be to permit the construction of a retail store for a produce food market. It was noted for Committee' s information within Report (Information Purposes) PD-17-84 submitted to the General Purpose and Administration Committee at their January 16, 1984 meeting, that an amendment to the Region of Durham Official Plan was require in order to proceed with the proposal . The appropriate approval (Amendment No. 104 to the Region of Durham Official Plan) by the Ministry of Municipal Affairs and Housing designating Maple Grove as a Hamlet, was received by staff on January 5, 1984. i COMMENTS: In accordance with departmental procedures the proposed rezoning application was circulated to all concern Town departments and outside agencies for their comments and/or concerns. The majority of the comments received did not identify any major objections to the rezoning application, but however did highlight concerns relative to "site plan matters" which will dealt with through the site plan approval process. The following comments pertaining to the applications specifically of a site plan nature are noted for Committee's information. .. .3 I CQ� REPORT NO. : PD-61 -84 Page 3 The Ministry of Transportation and Communications advises that the 0.3 metre reserve fronting the property on Highway No. 2, was established by Registered Plan 650; the purpose being to preclude direct access to Highway No.2. The entrance shown by the applicant cannot be recommended for approval , and all accesses will be restricted to Maple Grove. The Regional Health Unit advises that they have no objection to the proposal with the understanding that a Class 6 aerobic sewage system may be required pending soil findings at the time of the application for a private sewage system. Staff acknowledges the above-noted comments , and will discuss same with the applicant 's agent D.G. Biddle and Associates prior to the finalizing of a site plan agreement, pursuant to the approval of a zoning by-law amendment. In consideration of the application as submitted and the approval of Amendment No. 104 to the Region of Durham Official Plan, staff would have no objections to the approval of the zoning by-law amendment as attached hereto.
