SUBJECT: APPLICATION TO AMEND DURHAM REGIONAL OFFICIAL
PLAN - A. KLOMPMAKER AND P. VANDRUNEN
PART LOT 15, CONCESSION 3, DARLINGTON

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-64-84 be received; and
2. That the Region of Durham be advised that the
Town of Newcastle has no objection to Official
Plan Amendment application 83-30/D, submitted
by A. Klompmaker and P. VanDrunen to permit the
creation of seventeen (17) Estate Residential
lots in Part Lot 15, Concession 3, former
Township of Darlington, now Town of Newcastle ;
and
3. That the Region of Durham and the applicant be
forwarded a copy of Staff Report PD-64-84 and
Council 's resolution.

BACKGROUND:
On August 16, 1983, the Region of Durham advised the Town of
Newcastle that it had received an application to amend the
Durham Regional Official Plan. The purpose of the
application, submitted by Anthony Klompmaker and Patricia
VanDrunen, is to permit the creation of seventeen (17)
Estate Residential lots on a 10.3 hectare (25.5 acre) parcel
of land in Part Lot 15, Concession 3, former Township of
* Darlington (see attached key map). The site is designated
"Major Open Space" by the Regional Official Plan.
General Purpose and Administration Committee originally
dealt with the application through its consideration of
Staff Report PD-172-83, at its meeting of November 21 , 1983.
Staff noted that no major concerns regarding the technical
aspects of the development were highlighted as a result of
the circulation of the Official Plan Amendment application.
Staff further noted however that the proposed development
did not comply with the Regional Official Plan policies
relating to Estate Residential developments. The Official
Plan states that the estimated population yield from an
Estate Residential subdivision shall not exceed a density of
4.9 persons per hectare over the total site area. Staff
calculated that the proposed development would have a
density of 6.3 persons per hectare. The Official Plan also
states that a proposed Estate Residential development shall
not unduly restrict the use of adjacent properties for
agriculture. Staff noted that an apple orchard located
immediately to the south of the proposal is currently
bounded on the east by Regional Road No. 57 and on the west
by Old Scugog Road and a draft approved Estate Residential
subdivision, and that this proposal would result in

non-agricultural uses bordering the orchard on three sides.
In addition, the Official Plan indicates that an Estate
Residential development should be located in a scenic , well
vegetated area of rolling topography. The subject property
is an abandoned gravel pit levelled out to form a smooth
table land.
Staff also indicated some difficulty with the establishment
of another Estate Residential development in the Town. It
was noted in the report that there are a total of two
hundred and nine (209) approved Estate Residential and
Hamlet lots within the Town available for development within
the short term future.
Staff further noted that the proposal is located directly to
the north, and across Old Scugog Road from a draft approved
Estate Residential development with twenty-two (22) building
lots. The approval of this proposed subdivision would
result in thirty-eight (38) Estate Residential lots being
located along Old Scugog Road. This concentration .of
non-farm residential development would, in staff' s opinion,
compound the intrusion of nonfarm uses into a predominantly
agricultural area.
Staff recommended denial of the Official Plan Amendment
application. Committee resolved (Resolution #GPA-936-83) to
accept the recommendations in the staff report.
Subsequently, at the Council meeting of November 28, 1983,
Council resolved (Resolution #C-868-83) to refer the
application back to the Planning Department for further
review and report.

Staff met with the applicant on December 15, 1983, and
requested him to provide the Town with a Soil Report and a
statement from an Agronomist or the Ministry of Agriculture
and Food with respect to the agricultural capability of the
subject lands. Mr. Klompmaker advised that the Soil Report
had been submitted to the Region of Durham; staff
subsequently obtained a copy of this report. However, the
Soil Report did not address the question of agricultural
capability; rather the report discussed the suitability of
the soil for private sewage disposal systems and the
availability of water from drilled wells.
On January 11 , 1984, the Planning Department received a copy
of a letter from the Ministry of Agriculture and Food to Mr.
Klompmaker, advising that since no consideration was given
to proper agricultural rehabilitation when the gravel pit
was rehabilitated, the parcel of land has very limited
agricultural potential .
Despite the limited agricultural capability of the subject
parcel , staff are still of the opinion that the proposal
does not comply with the requirement for Estate Residential
proposals as outlined by the Durham Region Official Plan.
In addition, staff feel that there is currently an
oversupply of vacant Estate Residential lots in the Town ,
and that the development of this proposal could limit the
use of adjacent lands for agricultural uses. However, in
view ofthe opinions expressed by Council at the Council
meeting of November 28, 1983, indicating support for the
Official Plan Amendment application, and notwithstanding
staff's opinion that the subject application should be

denied, for the same reasons as outlined in Staff Report
PD-172-83, we are recommending that Council indicate to the
Region of Durham that the Town of Newcastle has no
objections to the subject Official Plan Amendment
application.
