CHOW PART LOT 13, CONCESSION 1 , BOWMANVILLE FILE: DEV 83-42 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-65-84 be received; and * 2. That the attached by-law to amend Zoning By-law 2111 , as amended, be forwarded to Council at such time as the applicant has satisfied the Region of Durham Works Department pertaining to the servicing of the proposed development. li i I . . .2 i REPORT NO. : PD-65-84 Page 3 has satisfied the Region of Durham Works Department pertaining to the servicing of the site. Staff would note that the majority of comments received did not identify any major objections to the rezoning application but however, did highlight concerns relative to "site plan matters" which will be dealt with through the Site Plan approval process. The following comments pertaining to the application, specifically of a site plan nature, are noted for Committee'.s information. The Central Lake Ontario Conservation Authority "Advised us that, provided the site is developed in accordance with the recommendations of the Soil Report as "N previously prepared, they would have no objection to the ' development of the site as proposed by the applicant. Further a Fill Permit will be required prior to the commencement of grading or filling on site. At the time of its issuance, the Conservation Authority, through specific conditions of approval , will endeavour to ensure future slope stability and protection of sensitive valley lands." The Town of ,Newcastle; Works,-:Department "Advised us, that although they have no objection to the _4 proposal , the following items will be reviewed prior to the approval of a site plan drawing. 1 . The access on to King Street has been reviewed and found that such an access will present traffic congestion and confusion with the left turn lane on to Old Scugog Road. Accordingly, the use of this access will require further review by Town staff and the applicant' s Engineer. 2. The curb and gutter on the west side of Old Scugog Road is to be extended southerly to meet the proposed access. The radii of the access should be curved to at least the property line. It would appear necessary to widen the road in order to extend the curb and gutter southerly to j obtain a smooth alignment. The alignment data will be provided by Public Works if this proposal proceeds. i . . .4 i i THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84- being a By-law to amend Restricted Area By-law Number 1587, as amended of the former Town of Bowmanville, now in the Town of ! Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law 1587, as amended, of the former Town of Bowmanville. NOW THEREFORE, the Council of the Town of Newcastle enacts as �i follows: 1. Schedule "A" to By-law 1587, as amended, is hereby further amended by adding the designation "SPECIAL CONDITION 33" to the zoning designation of the lands indicated as "ZONE CHANGE TO SPECIAL CONDITION 33" on the attached Schedule 'X' hereto, and by adding to the lands so indicated cross-hatching and the figure 33 encircled. 4 2. Schedule "B" to By-law 1587, as amended, is hereby further amended by adding hereto the following SPECIAL CONDITION 33: i SPECIAL CONDITION 33 The lands as shown on Schedule "A" cross-hatched and marked "SPECIAL CONDITION 33" shall be subject to the special regulations hereinafter contained and where there is any conflict between the regulations rr hereinafter set out and any provision of By-law 1587, then the ?r provisions of this SPECIAL CONDITION shall apply, but in all other respects the provisions of By-law 1587, as amended, shall apply. 1.1 DEFINED AREA The area su ject to this SPECIAL CONDITION is shown cross-hatched with the figure 33 encircled on the attached Schedule "A" hereto. 1.2 DEFINITIONS Eating Establishment Shall mean a uilding or part of a building where food is offered for sale or sold to the public for immediate consumption primarily on premises; and includes a restaurant, i dining room, cafe, cafeteria, ice cream parlour, tea or lunch room, dairy bar, coffee shop, snack bar or refreshment room or stand; but does not include a boarding or lodging home.
