SUBJECT: AMENDMENT TO SIGN BY-LAW 76-25, AS AMENDED,
RESPECTING THE USE OF THE COLOURS RED, GREEN,
AND AMBER.

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-71 -84 be received; and
* 2. That the attached By-law, being a by-law to
amend By-law 76-25, as amended, be approved.

BACKGROUND:
The original By-law 76-25 (May, 1976) in Section 4(3)(b) did
not permit illuminated signs using the colours red , green or
amber within 300 feet of a traffic control signal , nor
within 300 feet of an intersection of 2 or more streets.
The intent was to prevent any confusion with traffic signals
or signs being mistaken for traffic signal .
In December , 1976, Subsection (3)(b) was amended by adding
thereto, "This provision shall not apply to signs located
more than 25 feet from any street line".
A further amendment in May, 1979, deleted the Subsection in
its entirety and replaced it with the present Subsection (3)
(b) .
(b) RESTRICTION ON CERTAIN COLOURS
"No illuminated sign which uses the colour red,
green or amber, shall be located within 150 feet
of a traffic control signal nor within 150 feet
of an intersection of two (2) or more streets ,
except by special resolution of Council . This
provision shall not apply to signs located more
than 2.5 feet from any street line."
Since 1979, more than a dozen applications for signs using
red, green or amber have been received. From the time of
the initial inquiry and the preparation of a report with
recommendation to Committee, to the passing of a Special
Resolution of Council , and the issuance of a sign permit,
considerable time elapses . The applicant then places his
order with the sign company. Of the dozen or so
applications received, more than half did not request a
Special Resolution because of the time involved.

COMMENTS:
Staff have reviewed the procedure and discussed the concerns
with the Public Works Department. Because of their
knowledge and familiarity of the road system within the
Town, it would seem they are better able to assess the
situation than Building Staff, when a request is received to
use signs with red , green or amber.
Therefore, in order to expedite the procedure, it would seem
appropriate to amend the by-law to require written approval
from the Director of Public Works. This would reduce the
time involved and better achieve the intent of the present
Subsection regulating red, green or amber illuminated signs.
It is recommended that the attached amending by-law be
approved and forwarded to Council .

WHEREAS the Council of the Corporation of the Town of Newcastle has
deemed it advisable to amend By-law 76-25, as amended, of the Town of
Newcastle.

NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows: 4'
1. Section 4 of By-law 76-25 is hereby amended by deleting
Subsection 4(3)(b) in its entirety and replacing it with the
following Subsection:

"(b) Restrictions on Certain Colours
No illuminated sign which uses the colour red, green or amber
shall be located within 150 feet of traffic control signal nor
within 150 feet of an intersection of 2 or more streets, unless
written approval has been obtained from the Director of Public
Works. This provision shall not apply to signs located more
than 25 feet from any street line."
2. This By-law shall come into effect on the date of passing
hereof, f
