SUBJECT: PLAN OF SUBDIVISION - 18T-81023
APPLICATION FOR REZONING - J. ZURBA
BEING PART LOTS 19 & 20, CONCESSION 7
FORMER TOWNSHIP OF DARLINGTON - FILE: DEV 81 -15
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-74-84 be received; and
* 2. The attached by-law to amend Zoning By-law
2111 , as amended, in respect of Part Lot 19 &
20, Concession 7, former Township of Darlington
be approved.

BACKGROUND AND COMMENT:
Plan of Subdivision 18T-81023 received draft approval on
July 9, 1982, subject to the conditions set out by the
Region of Durham in a letter dated July 16, 1982. Condition
No. 11 and 12 therein, stated as follows :
"11 . That the area to be subdivided shall be zoned
to reflect the uses shown on the draft plan in an
appropriate zoning by-law passed by Council and
either:
a) submitted to and approved by the Ontario
Municipal Board; or
b) in effect, in accordance to Section 39(26) of
the Planning Act."
"12. That the Zoning By-law referred to in Condition
No. 11 shall contain provisions which would have
the effect of prohibiting all buildings and
structures in Block A, except those necessary for
flood or erosion control ."
Staff would note for the Committee's information, that the
attached by-law was prepared in consideration of the above-
noted provisions and concerns as expressed by the various
Town Departments and outside agencies as provided when draft
approval of the Plan of Subdivision was contemplated.
Staff would note as presently contained within the Hamlet of
Enniskillen Development Plan, areas designated for rural
residential development, would require staging for proposals
in excess of three (3) lots. However, such staging shall be
implemented through the provisions of a Subdivision
Agreement.
As noted within Staff Report PD-73-84 (Application -to amend
the Hamlet Development Plan for the hamlet of Enniskillen
Staging Policies) , Staff acknowledges this requirement and

and will provide for same within the Subdivision Agreement
as required.
Accordingly, in consideration of the above, Staff would have
no objections to the approval of the By-law amendment as
requested and attached hereto.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84-
being a By-law to amend By-law Number 2111 , as amended, of the former
Township of Darlington, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington, now in the Town of Newcastle.
NOW, THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1 . Section 13 of By-law 2111, as amended, is hereby further amended
by adding thereto the following subsection (ccc):
"(ccc) Part of Lots 19 & 20, Concession 7
Notwithstanding any provision of this By-law to the contrary
that Part of Lots 19 & 20, Concession 7, designated as
"SPECIAL PROVISION BY-LAW 84- " on the attached Schedule
"A" hereto shall only be used to aaccordance with the follow-
ing provisions. In the event that there is any conflict be-
tween the provisions of this Special Provision and any other
provisions of this By-law 2111 , as amended, then the provi-
sions of this Special Provision shall apply. But in the
event that this Special Provision is silent on any matter,
then the provisions of By-law 2111, as amended, shall apply.
The Block numbers cited herein refer to the Block numbers
identified on Schedule "X-1" hereto.
(i) Definitions
(a) Park, Greenbelt:
shall mean a public or private park, the main purpose of
which shall be the protection of open space areas and
natural watercourses, which may be used for recreational
activities including playing and athletic fields, but ex-
cluding any buildings or structures.
(ii) Permitted Uses
(a) Block 1:
- Park, Greenbelt
- Flood and Erosion Control Works
(b) Block 2:
one single family dwelling per lot, and uses, buildings
and structures accessory thereto.

(iii) Zone Provisions
a. Lot Area (minimum) 0.8 hectares
b. Lot Frontage (minimum) 45 metres
C. Yard Requirements (minimum):
i) Front Yard 6 metres
ii) Exterior Side Yard 6 metres
iii) Interior Side Yard 2 metres
iv) Rear Yard 10 metres
d. Floor Area (minimum) 110 square metres
e. Lot Coverage (maximum) 30 percent
f. Landscaped Open Space (minimum) 30 percent
g. Building Height (maximum) 10 metres
2. Schedule "A" to By-law 2111, as amended, is hereby further
amended by changing to "SPECIAL PROVISION BY-LAW 84- ", the zone
designation of the lands designated "SPECIAL PROVISION BY-LAW 84- "
on the attached Schedule "X" hereto.
3. Schedules "X" and "X-1" attached hereto shall form part of said
By-law.
4. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 34 of the Planning Act, as amended.
