SUBJECT: SUBDIVISION AGREEMENT - FILE: 18T-78006
NEWCASTLE SHORELINE PROPERTIES LIMITED
PART LOT 25, B.F.C. , FORMER VILLAGE OF
NEWCASTLE
RECOMMENDATION:
It is respectfully recommended to Council that
1 . The Report PD-76-84 be received; and
* 2. That the attached By-law authorizing the
execution of an agreement between Newcastle
Shoreline Properties Limited and the
Corporation of the Town of Newcastle be passed;
and
3. That the Town Clerk and Mayor be authorized to
execute the subject Subdivision Agreement upon
payment of all monies due under the terms of
the Subdivision Agreement.

BACKGROUND AND COMMENT:
Plan of Subdivision 18T-78006 was draft approved by the
Minister of Housing on April 14, 1980. The Plan covers a
6.25 hectare (15.45 acre) parcel of land in Part Lot 25,
Broken Front Concession, former Village of Newcastle and
involves the development of seven estate residential lots on

the south side of Lakeshore Road.
On March 1 , 1982, Council approved By-law 82-27 which
authorized the Town to enter into a Subdivision Agreement
with Newcastle Shoreline Properties Limited with respect to
the subject lands. However, on January 10, 1983, Council
adopted a resolution advising Newcastle Shoreline Properties
that failing payment of monies outstanding pursuant to the
terms of the Subdivision Agreement by March 1 , 1983, that
said Agreement shall be subject to renegotiation.
Inasmuch as the company failed to pay the monies by the
specified date, the Agreement became subject to
renegotiation. Newcastle Shoreline Properties recently
approached the Town regarding having the Agreement updated
and executed. Staff are satisfied with the previously
approved Agreement , but note that the development charges
payable under the Agreement, have been revised to reflect
1984 lot levies, and to incorporate a levy for rural fire
protection and a share of the upgrading of the CNR underpass
on Mill Street.
As well , the Works Cost Estimate has been updated to reflect
1984 costs. (.

Staff have prepared a By-law (attached) authorizing the
entering into the Subdivision Agreement, and repealing
By-law 82-27. It is recommended that Council approve the
by-law and that the Clerk and the Mayor be authorized to
execute the subject Subdivision Agreement upon payment of
all monies due under the terms of the Subdivision Agreement.

being a By-law to authorize the entering into of an Agreement with
Newcastle Shoreline Properties Limited.
The Council of the Corporation of the Town of Newcastle hereby enacts

F as follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
( ' Corporation's seal , an Agreement between Newcastle Shoreline
Properties Limited and the said Corporation dated the day of
C .t 1984, in the form attached• heret t"Schedule "V.
2. THAT Schedule "X" attached hereto forms part of this
by-law.
