SUBJECT: AMENDMENT TO SIGN BY-LAW 76-.2:9, AS AMENDED,
RESPECTING SIGN AREAS IN COMMERCIAL ZONES
RECOMMENDATION:
It is respectfully recommended, that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-78-84 be received ; and
* 2. That the attached By-law, being a By-law to
amend By-law 76 as amended, be approved.

BACKGROUND:
The Sign By-law 76-25 in Section 8(2)(b) (v) and 8(2) (b) (vi )
respectively, Commercial Zone permits ground Identification
Signs having a sign area of 30 square feet or 0.1% of the
lot area, whichever is the greater, and wall Identification
Signs, 30 square feet or 10% of the area of the wall ,
whichever is greater.
At present, the Sign By-law has had ten (10) "Special
Conditions", requests for exemption from the By-law. Most
of these deal with sign area.

COMMENTS:
Many of the applications for sign permits are for signs of a
greater area than permitted in the By-law. The maximum area
permitted by the "Special Conditions" has been 40 square
feet. This figure seems acceptable to both the applicant
and the Town.
Staff recently received two (2) further requests for signs
larger than those permitted. In review of these requests,
it would therefore seem appropriate to amend the By-law to
increase the area from 30 square feet to 40 square feet.
It is recommended that the attached amending By-law be
approved and forwarded to Council .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84- 48
being a By-law to amend By-law 76-25, as amended, of the Corporation
of the Town of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle has
deemed it advisable to amend By-law 76-25, as amended, of the Town of
Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Section 8 of By-law 76-25 is hereby amended by deleting
Subsection 8(2)(b)(v) in its entirety and replacing it with the
following Subsection:
(v) Group Indentification Signs
In the case of a ground sign, 40 square feet or 0.1% of the lot
area, whichever is the greater provided that in no case shall
any sign exceed 100 square feet in area.
In the case of a wall sign 40 square feet or 10% of the area of
the wall, whichever is the greater.
2. Section 8 of By-law 76-25 is further amended by deleting
Subsection 8(2)(b)(vi) in its entirety and replacing it with the
following Subsection:
(vi) Identification Signs
In the case of a ground sign, 40 square feet or 0.1% of the lot
area whichever is the greater provided that in no case, shall
any sign exceed 100 square feet in area.
In the case of a wall sign 40 square feet or 10% of the area of
the wall or portion of a wall directly associated with each
particular use, whichever is the greater, unless otherwise
specified within an approved site plan agreement entered into
pursuant to By-law 79-151, as amended.
3. This By-law shall come into effect on the date of passing
hereof.
