SUBJECT: APPLICATION FOR REZONING - OAKLAND DEVELOPMENTS
PLAN OF SUBDIVISION 18T-24002, PART LOT 18,
CONCESSION 7, FORMER TWP. OF DARLINGTON

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council -the
following :
1 . That Report PD-79-84 be received; and
* 2. That the attached by-law to amend By-law 2111 ,
as amended, be forwarded to Council at such
time as the Council of the Region of Durham has
considered the amendment to the Enniskillen
Hamlet Development Plan within Staff Report
PD-73-84.

7. "That prior to the signing of the final plan by
the Minister, we are to be advised that the
proposed subdivision conforms with the Restricted
Area By-law approved by the Ontario Municipal
Board under Section 35 of the Planning Act. The
zoning by-law shall include provisions requiring
that all structures on Lots 27, 2.8 and 29 be set
back 10 feet from the top of the bank of the
stream at the southwest corner of the property.
Staff would note for the Committee's information, the
attached by-law was prepared in consideration of the above-
noted provision and concerns as expressed by the various
Town Departments and outside agencies 1as provided when draft
approval of the Plan of Subdivision was issued.
Pursuant to Council 's policy requiring applicants to provide
public notice in respect of any rezoning application, an
information sign was installed upon the subject property
identifying the requested rezoning, along with the date and
location of the public meeting in accordance with the
requirements of the Planning Act.
It is noted for Committee' s information , that within the
draft approval originally issued January 25, 1974, a
parkland dedication was incorporated (north limits of site -
1 .73 acres). Subsequent thereto, the draft approval was
amended on July 17 , 1979, representing forty-four (44) lots
and five (5) blocks .
The Block relative to the parkland dedication was reduced to
a parcel size of 1 .48 acres. The most recent amendment to
the draft plan as considered by Council on November 14,
1983, increased the size component of the parkland
dedication to 1 .515 acres.

being a By-law to.Amend By-law Number 2111 , as amended, of the former
:. Township of Darlington, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington, now in the Town of Newcastle.
NOW, THEREFORE, the Council of the Corporation of the Town of
' Newcastle enacts as follows:
' 1 . Section 13 of By-law 2111, as amended, is hereby further amended
by adding thereto the following subsection (eee):
"(eee) Part of Lot 18, Concession 7
Notwithstanding any provision of this By-law to the contrary
that Part of Lot 18, Concession 7, designated as "SPECIAL
l , . PROVISION BY-LAW 84- " on the attached Schedule "A" here-
to shall only be useTin accordance with the following pro-
visions. In the event that there is any conflict between 1
the provisions of this Special Provision and any other pro-
;: visions of this By-law 2111 , as amended, then the provisions
of this Special Provision shall apply. But in the event that
this Special Provision is silent on any matter, then the
provisions of By-law 2111 , as amended, shall apply. The
Block numbers cited herein refer to the Block numbers iden-
tified on Schedule "X-1" hereto.
(i) Permitted Uses

(a) Block 1:
no person shall use, erect, place or alter any building,
structure, septic tank, or tile bed on, or alter any lands
within that area defined as Block 1, save and except for o
flood and erosion control works.
(b) Block 2: `
- one single family dwelling per lot, and uses, buildings
and structures accessory thereto.
(ii ) Zone Provisions j
