HomeMy WebLinkAboutPD-82-84 CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT T.T.EDWARDS,M.C.I.P.,Director HAMPTON,ONTARIO LOB UO TEL.(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF APRIL 2, 1984 REPORT NO. : PO-82-84 SUBJECT: APPLICATION TO AMEND DURHAM REGIONAL OFFICIAL PLAN - 542985 ONTARIO LIMITED PART LOT 15, CONCESSION 3, DARLINGTON FILE: 84-6/D RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-82-84 be received; and 2. That the Region of Durham be advised that the Town of Newcastle has no objection to Official Plan Amendment application 84-6/D submitted by 542985 Ontario Limited, to permit the creation of four (4) Estate Residential lots in Part Lot 15, Concession 3, former Township of Darlington, now Town of Newcastle; and 3. That a copy of Council 's decision and Staff Report PD-82-84 be forwarded to the Region and the applicant. * -2 e/ i 1 REPORT NO. : PD-82-84 Page 2 BACKGROUND: On February 9, 1984, the Region of Durham Planning Department advised the Town of Newcastle that it had received an application to amend the Durham Regional Official Plan, submitted by 542985 Ontario Limited to permit the creation of four (4) Estate Residential lots on a 2.13 hectare (5.26 acre) parcel of land in Part Lot 15, Concession 3, former Township of Darlington. The purpose of the application is to complete a twenty-two (2.2) Estate Residential subdivision currently in progress, south of the subject lands, and which was approved through Amendment No. 84 to the Durham Regional Official Plan, Plan of Subdivision 18T-82034, and which was recently rezoned through By-law 83-65. The lands subject to the Official Plan Amendment application were also the subject of Land Division application LD 2.04/83 which was considered by the Land Division Committee on June 20, 1983. In comments to the Land Division Committee on the application, Town Staff noted that the lands are designated "Major Open Space" by the Region of Durham Official Plan, and that in order to have the subject lands meld to the lands to the south, an Official Plan Amendment application is required. Staff further noted that the lands are zoned "A-Agricultural" and that an application for rezoning would be required for the subject lands in order to allow Estate Residential lots to be developed. Staff recommended approval , with one of the conditions being that the applicant apply and receive approval of an Official Plan Amendment. . . .3 I REPORT NO. : PO-82-84 Page 3 The Land Division Committee approved the application, with one of the conditions being that the applicant satisfy the Region with respect to an Official Plan Amendment if that was found to be necessary. In accordance with departmental procedure, the application was circulated to various departments for comment. As well , the Region of Durham provided copies of the comments received through their circulation of the application. All of the departments and agencies, with the exception of the Ministry of Agriculture and Food indicated no objection to the proposal . The comments from the Ministry of Agriculture and Food were as follows : "Consideration has been given to this proposal in terms of the goals and objectives of the Ministry and of the criteria and policies outlined in the Foodland Guidelines. Our concern of not encroaching on the orchard to the east can be accommodated by imposing a 61 metre separation distance between the subdivision and the orchard as shown on the proposed plan. If this condition is imposed, we have no further concerns and would not object to the proposal ". COMMENT: The property subject to the Official Plan Amendment application is designated "Major Open Space" by the Durham Regional Official Plan, and is located in the vicinity of the valley lands associated with Bowmanville Creek. These lands are designated "Environmentally Sensitive" and "Hazard Lands" by the Official Plan. The Official Plan requires the preparation of an Environmental Impact Study for development proposals on land designated as Environmentally Sensitive. . . .4 REPORT NO. : PD-82-84 Page 4 The proposed lots do not appear to extend into the valley lands; as well , neither Central Lake Ontario Conservation Authority nor the Ministry of Natural Resources has identified any concerns with the proposal . It would appear that an Environmental Study is not required. However, it should be noted that if the Official Plan Amendment application is approved and the proposal proceeds to the subdivision approval and rezoning stage, more specific comments relating to Environmental Sensitivity may be indicated at that time. The Durham Region Official Plan established its criteria by which an Estate Residential development proposal is to be considered. The four (4) proposed lots would appear to conform with the requirements in the plan. One of the criteria is that the proposal does not unduly restrict the use of adjacent properties for agriculture. The Ministry of Agriculture and Food identified a concern with an existing orchard across Old Scugog Road from the proposed lot, and requested that a 61 metre separation be imposed between the subdivision and the orchard. Staff note that the imposition of such a setback would not severly restrict the size of the building envelope on the lot closest to the orchard, and that the same restriction was imposed on the recently approved subdivision to the south. The Town recently entered into a Subdivision Agreement with 542985 Ontario Limited with respect to the development of the approved subdivision to the south. Staff note that should this Official Plan Amendment application be approved and proceed through the subdivision approval stage, that the Subdivision Agreement will have to be amended to incorporate the subject property. . ..5 REPORT NO. : PD-82-84 Page 5 Inasmuch as no major concerns with the proposed development were identified and that the proposed lots are a logical extension to the approved Plan of Subdivision, staff would have no objection to the approval of the Official Plan Amendment application.
