KLOSE PART LOT 25, CONCESSION 5, CLARKE FILE: DEV 84-1 RECOMMENDATION: It is respectfully recommended to Council that 1 . That Report PD-89-84 be received; and 2. That the By-law attached to Staff Report pD-89-84 to rezone a 4.0 hectare parcel in Lo 25, Concession 5, former Township of Clarke to permit the development of a private zoo and fitness centre now be approved in accordance with Resolution #GPA-215-84; and request 3. That Council consider the applicant' s in respect of approving the erection of a sign on the property covered by the subject by-law which would have an area of 51 square metres and approve same being in conformity with the applicable Provincial regulations and being the sign promoting a tourist attraction within Town. , . .2 REPORT NO. : PD-89-84 Page 2 BACKGROUND AND COMMENT: On March 5, 1984, the General Purpose and Administration Committee considered Staff Report PD-56-84, which dealt with an application submitted by Mr. W. Klose to rezone a 4.0 hectare (9.9 acre) parcel of land in Part Lot 2.5, Concession 5, former Township of Clarke to permit the development of a Private Zoo and Fitness Centre. A public meeting with respect to the proposed rezoning was also held. Staff recommended that the application be approved and brought forward a draft by-law to rezone the subject property. Staff noted that there were a number of aspects of the proposed development which would be dealt with through the Site Plan Agreement with the applicant and therefore, recommended that the By-law not be forwarded to Council until such time as a Site Plan Agreement with the applicant has been finalized to the satisfaction of Staff. This recommendation was approved by Committee (Resolution #GPA-215-84) and subsequently endorsed by Council on March 12, 1984 (Resolution #C-175-84) . A number of revisions were made to the by-law after it was originally considered by Committee, in order to incorporate comments provided by the Town Solicitor. However, these revisions are of a minor nature and therefore, the holding of a new public meeting is not required in Staff's opinion . The Site Plan Agreement with the applicant has now been signed. Therefore, it is recommended that the by-law * attached to this report, to rezone the subject property to permit the development of a Private Zoo and Fitness Centre , now be approved. . . .3 REPORT NO. : PO-89-84 Page 3 In the Site Plan Agreement , the applicant has proposed to erect a sign to advertize the Private Zoo, which would be located along the west property line facing Highway 35/115 * (see attached). The proposed sign would have an area of 51 .0 square metres (550 square feet) , with the main portion of the sign having an area of 38.4 square metres (413 square feet) , while the upper portion of the sign into which the lion and tiger would extend, would have a total area including unoccupied space, of 12.5 square metres (135 square feet). The Sign By-law (By-law 76-25) permits the erection of a maximum of two identification signs on the subject property, each with an area no greater than 4.6 square metres (50 square feet) . The Sign By-law permits Staff to vary the area of signs within a Site Plan Agreement. However, the area of the sign as proposed by the applicant, would be over ten times that permitted for the property by the Sign By-law, and over five times the area of the largest sign permitted by the By-law, which is 9.3 square metres (100 square feet). Staff do not feel that a variation of this extent on the area of the proposed sign should be approved through the Site Plan Agreement without Council 's consideration. The Ministry of Transportation and Communications regulates all signs within 400 metres (1312 feet) of a Provincial Highway, with the permitted area of the sign being determined by its distance from the highway. The sign being proposed by the applicant would be located 165 metres (541 feet) from the nearest point of Highway 35/115. The . . .4 REPORT NO. : PO-89-84 Page 4 Ministry Regulations would permit a sign with a maximum area of 51 square metres (550 square feet) within this distance. Staff note the proposed sign would be the maximum area permitted by the Ministry. Inasmuch as the proposed sign meets with the requirements of the Ministry of Transportation and Communications and would be promoting a tourist attraction located in the Town of Newcastle, Staff recommend that Council endorse approval of the erection of a sign with an area of 51 square metres (550 square feet) on the subject property.
