SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF MARCH 14, 1984
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-91-84 and the minutes of the
Committee of Adjustment meeting of March 14,
1984 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of March 14, 1984. This list includes the file
number, applicant ' s name, site location , type of variance
requested, Official Plan conformity, By-law conformity,
staff's comments on the applications, and the Committee of
Adjustment 's decision.

to the adjoining property, thus resulting in a lot with an area of
4950 sq. ft. , instead of the required 5000 sq. ft. lot, with a
single family dwelling having a side yard of 3.69 feet (1 . 13 m) ,
instead of the required 4 ft. (1 .25 m) side yard, with an accessory
building having a rear yard of . 12 feet, instead of the required
4 ft. rear yard.
Mr. A. Strike and Mr. Read appeared in support of this application.
No other person appeared in support of or in opposition to this
application.

"THAT as the variance would not offend the intent
of the Official Plan or Zoning By-law and is
considered minor in nature and would not have a
detrimental effect on abutting properties,
permission is GRANTED to sever a strip of land, to
be added to the abutting property, thus resulting
in a lot with an area of 4950 sq. ft. , and a single
family dwelling having a side yard of 3.69 ft. (1 .13 m) ,
with an accessory building having a rear yard of
.12 feet."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to convert the existing dwelling into
a commercial use, as permitted within this General Commercial Zone,
with no off-street parking provided.
Mr. A. Quinney, Mr. Burke and Mr. MacDonald appeared in support of
this application. Mr. Ricard appeared in opposition to this
application. No other person appeared in support of or in opposition
to this application.
Moved by Mr. Muir, seconded by Mr. Rehder,
"THAT as 7.16 of the Bowamnville Zoning By-law
would require that this proposed commercial
operation have a minimum of 3 (three) parking
spaces provided on the same lot, and as this
operation is unable to provide any parking space,
the requested variance is not minor in nature and
is, therefore, DENIED. "

A 17/84 - Randy Eastabrook, Part Lot 30, Concession 5, Clarke.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a single family dwelling,
leaving a front yard of 34 feet and side yards of 11 feet and 16
feet, instead of the required 50 ft. front yard and 25 ft. side yards.
Martin Zegers appeared in support of this application. Gary Hancock
and Robert Plazek appeared in opposition to this application stating
their objection with respect of the drainage around this lot. No
other person appeared in support of or in opposition to this application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT as the proposed dwelling will have the same
set backs and front yards as the two houses to the
north and as the location of the house and tile
bed on the lot have been approved by the Ganaraska
Conservation Authority, permission is GRANTED to
construct the house with a front yard of 34 feet
and side yards of 11 feet and 16 feet, instead of
the required 50 ft. front yard and 25 ft. side
yards. "
