That Report PD-98-84 and the minutes of the Committee of Adjustment meeting of April 4, 1984 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and * Administration Committee, staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of April 4, 1984. This list includes the file number, applicant' s name, site location , type of variance requested, Official Plan conformity, By-law conformity, staff's comments on the applications , and the Committee of Adjustment 's decision. Yellowlees APPLICATIONS: A 18/84 - Gordon Denyer & Diane Piper, Lot 10, Concession. l , Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the use of a lot with an existing single family dwelling having a legal non-conforming front yard of 18.92 feet, instead of the required 20 ft. front yard. Brian Groves appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Muir, seconded by Mr. Rehder, "THAT as the requested variance does not offend the intent of the Official Plan or Zoning By-law and would permit the continuation of the existing -non- conforming dwelling, permission is GRANTED to continue the use of an existing single family dwelling having a legal non-conforming front yard of 18.92 feet." A 19/84 - Davill Property Management Limited, Lot 11 , Concession 1 , Bowmanville Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the use of a lot having a frontage of 72.5 feet, instead of the required 80 ft. frontage with an existing multiple family dwelling having side yards of 15.3 feet and 13.3 feet, instead of the required 20 ft. side yards. Mr. R. Nato appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Murdoch, THAT as this variance would not offend the intent of the Zoning By-law or Official Plan and would permit the continued use of the subject land, this variance is considered minor and permission is GRANTED to continue the use of a lot with a frontage of 72.5 ft. with a multiple family dwelling having side yards of 15.3 feet and 13.3 feet." Application was made for relief from zoning by-law requirements in order to permit the applicant to install a propane tank in the front yard, instead of being located wholly in the rear yard, as required. Mr. Paul Welsh appeared in support of this application. Mr. G. Grace appeared with interest in this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Reicheld, seconded by Mrs. Payne, "THAT as the variance would not offend the intent of the Zoning By-law or Official Plan and would not be detrimental to the area and as the installation of this propane tank in the front yard would not effect the traffic flow and would be more visable and accessable to motorists, permission is GRANTED to construct this tank in the front yard, conditional upon site plan approval . Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to the existing single family dwelling maintaining the existing legal non-conforming front yard of 34.28 feet, instead of the required 50 ft. front yard. Mr. Adie appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Muir, "THAT as the proposed addition to the single family dwelling would not offend the intent of the Official Plan or Zoning By-law provisions and as the variance is considered to be minor in nature, permission is GRANTED to construct the addition maintaining a legal non-conforming front yard of 34.28 feet, instead of the required 50 ft. front yard. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a second storey addition over a portion of the existing single family dwelling, maintaining an existing non-conforming 3 ft. side yard, instead of the required 4 ft. side yard, plus 2 ft. for each additional storey. Mr. Norton appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mrs. Payne, "THAT as the requested variance would not offend the intent of the Official Plan or Zoning By-law, permission if GRANTED to construct a second storey addition over a portion of the existing single family dwelling, maintaining an existing non-conforming 3 ft. side yard, instead of the required 6 ft.
