A copy of the complaint which outlines the incident in detail is attached hereto as Attachment NO.1. A witness statement has been filed by Jeff Knox and is included as Attachment No.2. The dog owner, Mr. James Garrow, states that the dog was never out of the house on that day other than quick 5-minute intervals (see Attachment No.3). On January 22, 2003, a witness statement was filed by Randy Chopik which indicates the incident did not happen (Attachment No.4). Upon investigation of the incident, the Animal Services Officer issued an "Order to Restrain" pursuant to By-law 99-90, as amended. The order requires Mr. Garrow to: 1. licence and register the dog with the Clarington Animal Shelter and have the dog permanently identified by microchip implantation 2. notify the animal shelter staff immediately upon relocating the dog or upon transferring ownership of the dog 3. restrain the dog at all times, while the dog is on his own property, by keeping it enclosed in a pen or other enclosure in such a manner as to prevent the dog from leaving the property and to prevent contact with people and other animals 4. restrain the dog at all times, while the dog is off his own property, with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older. Mr. Garrow has indicated his desire to address Council regarding this matter on February 10, 2003. Mr. Park and Ms. Carter have also indicated that they will be in attendance to address Council. I was out of town on the 30th of November and returned on Dee 1/02. Upon arriving home, I was given the details by our two boys (age 17 & 19). John McAlpine, who was outside his residence in the driveway, was alerted by the yells of Harry and Jeff. He attempted to get close enough to extract the cat from the jaws of the larger "Boxer type" dog. He was unable to do so. The dogs then proceeded further east to another residence on the north side of Con. #6 where the owner "shooed" the dogs from her yard. They continued east on Con. #6 in the direction of the Garrow residence.. (December 01/02) I went to the residence of Jeff. Knox where I got a detailed description (as above) of the two dogs. The description closely matched that of a dog (Bull Mastiff) at the residence of Jim & Karen Garrow at 2033 Con. #6. I went to the Garrow residence to tell them what had transpired on the previous day. I spoke with Jim Garrow in his driveway and relayed the story as to what had transpired the previous day. I was told that Karen had let the dog out the previous day for no more than 15 minutes (around 2 PM) and. that their Bull Mastiff would not do this. I explained that I would contact Animal Control and file a report, then left for home. About 1 hour after leaving the Garrow residence, both Jim and Karen Garrow came to my residence (without the dog) to further plead the innocence of their dog. Both my wife and I asked them to verify the innocence of their dog by allowing Jeff Knox to see the dog so he could either confirm or disprove guilt. They agreed to do so At approximately 7 PM Jeff Knox went to the Garrow residence and confirmed that it was the Garrow's Bull Mastiff that had killed the cat. NOTE: As of today we are still unable to positively determine the identity and location of the white dog.
