IV -.-- Page 6 COUNCIL MINUTES The regular meeting of Bowmanville Town Council convened at 8:00 p.m. on Tuesday, September 7, 1965 in the Council Chambers, Town Hall with His Worship Mayor Ivan M. Hobbs in the Chair. All members present, I LORD'S PRAYER: II ADOPTION OF MINUTES: Moved by Con. Hughes, seconded by Con. Hooper. THAT the minutes of the meeting held on Monday, August 16th, 1965 be received and adopted. "CARRIED" III DELEGATIONS: 1. Ontario Street Sidewalk: Mr. W. Dempsey appeared before Council and presented a revised Engineer's Report in respect to the construction of a local improvement sidewalk on Ontario Street. This revision was effected as a result of Council's request that necessary pro- vising be made for adequate drainage after the construction of the sidewalk was effected. Mr. B. Payne, one of the peti- tioners, was present and asked several questions in this regard and suggested that the drainage problem had resulted due to the Town raising the grade of the Roadway and consequently they should not be charged with the storm sewer. Following consid- erable discussion it was: Moved by Con. Hughes, seconded by Reeve Little. THAT the matter of the local improvement sidewalk on Ontario Street be tabled. "CARRIED" COMMUNICAT IONS: 1. Town of Fort Frances: "WHEREAS the Public Hospitals Act R.S.O. 1960, Chapter 322, Section 20, places upon a municipality the responsibility for payment of burial expenses for any indigent resident in such municipality who dies in hospital. AND WHEREAS the said Section 20 of the Public Hospitals Act establishes a minimum but no maximum cost for such burial ex- pense and does not provide any power to control the cost of such burial expense. AND WHEREAS Regulation 207, Section 35, under the General Welfare Assistance Act provides that the expense of burial of indigent persons whose residence at the time of death was in territory without municipal organization may be borne by the Province of Ontario but such regulation establishes a maximum cost for such burial expense. AND WHEREAS the minimum cost established for municipalities is the same amount as the maximum cost established for the Province of Ontario. . ... . e . -. Page 7 - 2 - AND ~H3REAS in municipalities having only one Funeral Director the expense to such municipalities may exceed the expense to municipalities having more than one Funeral Director. AND WHEREAS there does not appear to be any statutory or regula- tory enactment establishing a rate for burial of indigent persons in the event of death of such indigents in places other than in hospital or Homes for the Aged. AND WHEREAS it would be of great benefit and assistance to all municipalities if the statutory provisions and regulations re- garding burial of indigent persons were gathered together into one statute covering such matters as responsibility, procedure and expense. THEREFORE, be it resolved that the Legislature of the Province be requested to revise the present structure of Section 20 of the Public Hospitals Act to provide the municipalities with some control over the establishment of a rate for the burial of indigent persons in conformity with the control afforded the Province of Ontario. AND BE IT FURTHER RESOLVED that the Legislature of the Province of Ontario be requested to revise the present statutory and re- gulatory enactments dealing with burial of indigent persons in order that all such enactments may be gathered into one Statute covering such matters as responsibi'ity, procedure and expense. AND BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Honourable Louis Cecile, Minister of Public Welfare for the Province of Ontario, the Northwestern Ontario Municipal Association, the Local Member of the Legislative Assembly of Ontario, and to other municipalities in Ontario requesting their support." Moved by Con. Hooper, seconded by Con. Chant. THAT the resolution received from the Town of Fort Frances respecting indigent burials be received and filed. "CARRIED't 2. Ontario Water Resources Commission: "The provisions of The OWRC Act for pollution control and Objec- tives for Industrial Waste Control which have been set out by the Commission have recently been brought to the attention of industries from which wastewaters are discharged directly to public waters in the Province. A copy of our communication to some 400 to 500 industries throughout the Province is attached for your information. The Commission is asking for prompt action by industry to correct all discharges that do not meet the Objectives and intends to pursue this aspect of pollution with all practical haste. If you are aware of industries located in your municipality with waste discharges other than to municipal sewers, and which may not conform with the Objectives, you should advise the Com- mission so that the requirements for waste discharge can be brought to the attention of the industry if this has not yet been done. We should also be advised should a new industry con- template locating in your municipality, or an existing industry plan a significant expansion or process change that would have a bearing on the quantity or quality of wastes to be discharged in public waters. . Page 8 - 3 - The Commission considers that the municipalities in the Province are responsible for the control of pollution arising from muni- cipal facilities, and feels, therefore, that industrial waste dischares to municipal systems should be regulated. It is strongly urged that control by municipal ordinance should be implemented, an~" where this has not yet been done, it is recommended that a suitable Sewer-use By-law be enacted and enforced. The staff of the Commission will be prepared to offer assistance in setting out a schedule of control limits for this purpose." Moved by Con. Hughes, seconded by Con. Rundle. THAT the letter received from the O.lli .H.C. respecting pollution control be received and filed for future reference and that a copy of this letter be referred to the Industrial Committee for their information. "CARRIED" 3. Select Committee on Conservation Authorities: "The Select Committee on Conservation Authorities appointed by the Legislative Assembly of the Province of Ontario on June 22nd, 1965, is inviting the filing of briefs and submissions by con- servation authorities, municipalities, associations and indivi- duals. They should be forwarded to the Secretary by October 15th, 1965, at the above address. Hearings will commence sub- sequent to that date. Enclosed is a copy of an advertisement which will appear in the daily and weekly newspapers throughout the Province during the week commencing August 23rdl 1965. Your co-operation in informing interested parties will be greatly appreciated." Moved by Deputy Reeve Stevens, seconded by Reeve Little. THAT the letter received from the Select Committee on Conserva- tion Authorities, dated August 17th, 1965, be received and that our Conservation Authority representative prepare a brief out- lining the several opinions expressed by this Council in this respect, A substitute motion was then presented as follows: Moved by Con. Hooper, seconded by Con. Hughes. THAT the Reeve and Deputy Reeve take this matter up at the next regular County Council session asking that they consider this matter. fICARRIED" 4. Guy Leblanc: "On the 31st of July, 1965 ]Vir. Dewith and I purchased an apart- ment house located at 90 Queen Street, Bowmanville. We have had several complaints from our tenants about the drive- way and I am sure that something could be done about it. At one time I understand that the town had put asphalt from the street to the sidewalk which made the matter worse. . . '. Page 9 . 4 - I hope that you can look into the matter as soon as possible." Moved by Con. Hooper, seconded by Con. Prout. THAT the letter received from Guy Leblanc, dated August 16th, 1965, be received and referred to Roads & Streets for report. ltCARRIED" 5. W. Frank Real Estate: "Regarding our new offic e at 21 King Street '~vest, I am having difficulty in getting up to the sidewalk from the curb due to the large step between the curb and the top of the sidewalk. If this could be ramped with asphalt I would be glad to pay the cost. . I would also appreciate if you could reserve one parking space in front of the office for my car. I have seen this done in other towns." Moved by Con. Hooper, seconded by Con. Hughes. THAT the letter received from W. Widen Scugog Street North from King Street to O'Dell Street. 4. Stop sign on Lamb's Lane at O'Dell Street. 5. Stop signs on Lamb's Lane, both north and south of Second Street. 6. Police & Finance Con~ittee: "At a joint meeting of the Police & Finance Committee held on Monday, August 30, 1965, with all members present, it was dis- cussed about the matter of clerical help in the police office. After considerable discussion it was moved and seconded: THAT we recommend to Council that Mr. L. Piper be transfered to the Police Office effective September 13, 1965, to work under the jurisdiction of the Police Committee. All benefits to be the same as he now receives. Pickers- gill, Minister of Transport, respecting this matter and I have asked him to advise the officers of C.P.R. of necessity, in the public interest, that reconstruction be commenced as quickly as possible. When I have a reply from the Minister I will be in touch with you again." C.P.R. Superintendent: "Reference your letter August 19th regarding reconstruction of Elgin Street bridge. Please be advised that we are presently arranging for desig~ of a new structure. However, it is anticipated that it will be several months before any construction is started at this location. Murdoch as legal council in the matter of the Town waterline in Darlington Township and that His Worship the Mayor appoint a special Co~nittee of three to deal with this matter.
