THAT the minutes of the meetings held on Monday, May 3rd and Tuesday, May 13th, 1965 be received and adopted. "CARRIED" PETITIONS & DEPUTATIONS: 1. The following petition was received from a group of young people from the Town represented by Mr. D. Fornataro: "It is the desire of a group of young people of this town to form a Young People's Club and to use a building on Ontario Street. We ask permission of Council to do this. I have been appointed to represent these young people. II Mr. Fornataro, j~. Neil Newton and Mr. Ted Bate, members of the delegation in support of the petition, outlined the views of those assembled indicating the need for facilities for their particular type of entertainment. In opposition to the foregoing the following petition was received from residents of the area where the Club rooms were being con- sidered: "Having heard that it has been proposed to convert the Bethel Church property, owned by Miss H. Van Dusen, located just north of King Street east on Ontario Street, to a coffee house, we the undersigned object very strenously for two reasons: 1. There are no facilities for parking and the street is too narrow, and 2. This area is composed chiefly of dwellings which would be greatly affected value-wise should such a change be allowed, mainly because of noise and general disturbance to an other- wise fairly peaceful area." Speaking on behalf of the residents assembled were j.~. J. Hayman, Miss Margaret Corden, ~~s. Black and j~. J. Van Nest. Following a general questioning of both sides in this matter His Worship the Mayor advised that the owner of the building in question should make themselves aware of the provisions of the Town's By-law No. 1423 entitled ;'A By-law to Govern and Regulate Public Halls in the Town of Bowmanville", as a licence would be required prior to establishment of this building for public use. The By-law be stated, outlined the necessary procedure and re- gulations relevant in this respect and the penalties for non- compliance. ~. . . . - 2 - The matter of persons living in Commercial properties was also discussed and the owner again was advised to be aware of the provisions of the Town's Zoning By-law in this respect. Mr. Fornataro thanked Council for having heard their case and lf~. Hayman expressed thanks on behalf of the residents. 2. Third Street Residents: Residents of Third Street were present to hear a report of the Public Property Committee dealing with a Park Land matter which they had discussed with Council on May 3rd, 1965. Those present were given a copy of the report, dated June 1, and were advised that they would be allowed to speak on the report prior to consideration by Council. Following considerable debate it was: Moved by Con. Chant, seconded by Deputy Reeve Stevens. THAT the report of the Public Property Committee, dated Tuesday, June 1st, 1965 be received and adopted. "CARRIED" V COMMUNICATIONS: 1. Metropolitan Toronto and Region Transportation Study: "I am taking the liberty of sending along to you a copy of a Public Notice, which is appearing in news media throughout the region, in order to draw to the attention of your Council the plans of the Metropolitan Toronto and Region Transportation Study to hold public hearings dealing with co-ordinated trans- portation planning. Should your Council be interested in making a submission or wish further information about the hearings, please contact Mr. P. E. Wade, Study Director, at the above noted address. It is the plan of the Study to hold several meetings at locales that will be easily accessible to interested parties in various sections of the region. I am also enclosing a brochure which briefly deals with the broad aspects of the Study to give you a clear idea of its role in transportation planning." Moved by Deputy Reeve Stevens, seconded by Con. Hooper. THAT the letter received from the Metropolitan Toronto and Region Transportation Study, dated May 27, 1965, be received and filed. "CARRIED" 2. Minister of Municipal Affairs: "Re: Central Ontario Joint Planning Area In accordance with the provisions of sections 2 and 4 of The Planning Act, I hereby: (a) Define all of the City of OShawa, all of the Towns of Bowman- ville and Whitby, and all of the Townships of Darlington, . . . e - 3 - Whitby, and East v{hitby, each as from time to time con- stituted, as a planning area to be known as the "Central Ontario Joint Planning Area"; (b) Name the City of Oshawa to be the designated municipality in the Central Ontario Joint Planning Area; (c) Designate the name of the planning board for the Central Ontario Joint Planning i,rea to be the "Central Ontario Joint Planning Board"; (d) Designate the functions of the Central Ontario Joint Plan- ning Board to be those duties of planning boards set out in section 10 of The Planning Act, exclusive of those fun- ctions as are specifically allocated from time to time to the planning boards of any subsidiary planning areas that are or may be defined in the Central Ontario Joint Planning Area. In accordance with the provisions of section 5 of The Planning Act, I hereby vary the constitution of the Central Ontario Joint Planning Board so that: (a) The Planning Board will comprise four members (two of whom may be members of the municipal council) to represent the City of Oshawa and two members (one of whom may be a member of a municipal council) to represent each of the other local municipalities included in the Central Ontario Joint Plan- ning Area. In addition, the Mayor of the City of Oshawa, as head of the council of the designated municipality, will be a member ex officio of the Planning Board and may with the approval of the City Council, appoint a substitute to act for him from time to time. The appointment and re- appointment of members will be subject to approval under section 3 of The Planning Llct; and (b) Notwithstanding the provisions of subsection 3 of section 4 of The Planning ,1.ct, the members of the Planning Board who are members of municipal councils may constitute a majority. It is my understanding that representatives of the six munici~ palities in this Planning llrea have agreed on the following form- ula for the initial appointment of non-council members to the Planning Board: Number of members with Municipality Oshawa (City) Whitby (Town) Bowmanville (Town) Whitby (Township) East Whitby (Township) Darlington (Township) 1 3 2 2 The subsequent appointment of non-council members will be for three-year terms of office, of course, and councillors will each serve a one-year term. . . . . - 4 - Except as provided in this letter, the provisions of The Plan- ning Act continue to apply to the Central Ontario Joint Planning rlrea and to the Central Ontario Joint Planning Board. The following planning areas will continue as subsidiary plan- ning areas within the Central Ontario Joint Planning ,crea: Oshawa Planning ,lrea The Town of vlhitby Planning Area The Bowmanville Planning Area The Darlington Planning Area The Township of Whit by Planning :trea The East Whitby Planning Rrea. It shall be the function of the planning boards of these sub- sidiary planning areas to carry out the duties of planning boards that are set out in section 10 of The Planning "ct, insofar as these relate primarily to their respective planning areas and exclusive of those functions that are specifically allocated from time to time to the Central Ontario Joint Planning Board. I am sending copies of this letter to the clerks of the other local mun ipalities and to the secretaries-treasurers of each of the planning boards in the Central Ontario Joint Planning Area, for the information of their respective local authorities." THRT the letter received from the Minister of Municipal nffairs regarding the establishment of the "Central Ontario Joint Plan- ning ",rea", dated May 12, 1965, be received and referred to the Striking Committee with power to appoint the necessary represent- atives. "CARRIED" 3. Oshawa Regional Planning ,cssociation: "The Oshawa Regional Planning "i.ssociation at their meeting of May 20, 1965, passed the following motion: Moved by I~. Wilson, seconded by lVIr. Lyeett, "That the members of the Central Ontario Joint Planning Board be invited to the next regular meeting of the Oshawa Regional Planning ,cssociation for the purpose of initiating the first meeting of the Central Ontario Joint Plan- ning Board and that the participating municipalities be requested to forward their resolution naming their appointees to Oshawa in time for the meeting of City Council on June 7th." C"\RRIED. The membership were of the opinion that if a special effort could be made to have all resolutions in to Oshawa City Council in time for their June 7th meeting the necessary by-law incorporating all the resolutions could be drafted and passed. The by-law will then be forwarded to the Minister for his approval and we hope the new Board will be constituted by our next regular meeting on June 17, 1965." The Oshawa Regional Planning Association is to be advised of our representatives as provided for in the foregoing resolution. 4. Township of Hope: "The following resolution was passed at the regular meeting of Hope Township Council held April 30, 1965: . e . . - 5 - 'Be it resolved that the Township of Hope recommend to the other Municipalities of the Durham County District High School ,Irea, that a more equitable distribution of costs for the High School Area be made than on the present assessment basis, that a system calculated on a 50% assessment and 50% pupil basis be adopted by the Munic ipalit ies of the High School "rea'. THAT the resolution received from the Township of Hope, dated May 4, 1965, regarding the distribution of High School costs be received and referred to the Finance Committee. "CARRIEDrt 5. City of Toronto: rtThe following resolution was adopted by the Council of the City of Toronto at its meeting held on April 29, 1965, viz.: 'TH;'..T WHERE"S the City of Toronto and other municipalities have made representations to the appropriate legislative committees of the Ontario Government to secure adequate legislation to permit control of trucks in public lanes and on each occasion the required amendment to the Highway Traffic "ct was refused; J,ND WHERE"S the use of narrow lanes by large trucks causes damage to adjoining premises; ilND vJHEREicS the urban members of the Legislative "ssembly should be advised of this problem and representations should again be made to the Province for the purpose of receiving the necessary legislation; ;'eND WHERE"S the meaning of the word 'lane' is not defined in the statutes but if the word 'highway' is used in the proposed legis- lation the same would include the type of small thoroughfare usually referred to as a lane, and the proposed legislation could therefore be drawn in such manner as to apply to highways having a travelled portion of a width of 14 feet or less; THEREFORE BE IT RESOLVED that the Provincial Government be re- quested to add to Section 58 of The Highway Traffic ,lct a new subsection (2e) as follows: '2(e) The Council of a City may by by-law provide that no vehicles having greater widths than those respectively prescribed in the by-law shall be operated on such highways or parts thereof as are respectively designated therein, provided no such highway or part thereof shall be so designated if the width of the travelled por- tion thereof is greater than 14 feet'; AND FURTHER that the Ontario Municipal ,lssociation, the ,Issocia- tion of Ontario I~yors and Reeves and the Councils of other Ontario towns and cit ies be requested to endorse this resolution. ," Moved by Con. Hughes, seconded by Con. Hooper. THAT the resolution received from the City of Toronto respecting amendment of the Highways Traffic ,ect as it pertains to Public Laneways be received and filed. "C;:eRRIED" . . . . .. - 6 - 6. Ontario Department of Highways: "The Honourable C. S. Hac Naughton, Minister of Highways, has authorized the approval of the above cited by-law to a limit of $ 20,000.00 for Construction, $ 35,000.00 for j\lIaintenance, and f.o 55,000.00 Total 'i!> Please be advised that expenditures in excess of either the construction or maintenance limits will not be eligible for sub- sidy unless covered by a supplementary by-law approved by the Minister. Supplementary by-laws must be in the hands of the District Engineer not later than July 31, 1965. This approval is given subject to the approval of each individual work of construction and of contracts for construction or main- tenance. You are requested to report all proposed works to your District Engineer and to obtain his consent. In the event that any portion of the cost of the proposed work or purchase is to be raised in a subsequent year or financed by the issue of debentures, the approval of the Ontario Municipal Board must be obtained before the work or purchase is authorized or any commitment made with respect thereto. One copy of the by-law as approved is returned herewith." Moved by Con. Rundle, seconded by Con. Hooper. THAT the approval of the Town's Road Expenditure By-law received from the Ontario Department of Highways be received and filed. "CARRIED" ~. The Hydro-Electric Power Commission: "Upon checking our records, we find no easement has been secured to cover the occupation of this Commission's pole line crossing your property above described as indicated on the attached plan NQ. 204-9238. The rights reguired by this Commission are itemized as follows, amounting to '83.05: 2 Poles, #900, 901 @ $14.00 $28.00 2 Poles, #395, 396 @ 5.00 10.00 1 Anchor, #901 @ 14.00 14.00 Separation Allowance, 15' @ .25 3.75 Right-of-Way, 42 rods @ .65 27.30 .:M3.05 The amount offered is considered fair and reasonable, being con- sistent with prices paid for similar privileges in the district. If satisfactory, would you kindly have the proper signing auth- orities execute and return the attached original Agreement and Grant of Easement, in duplicate, having your Corporation seal affixed. Rundle, Chairman of the Civic Committee, advised that all arrangements had been made for the forthcoming Decoration Day, June 20th, 1965, and encouraged as many members of Town Council to attend as possible. 14.
