HomeMy WebLinkAbout2001-195 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 2001-195 Being a By-law to authorize an application to be made to Council as the approving authority under the Expropriation Act, R.S.O. 1990, c.E.26 for the approval of the expropriation of all interests in the lands described as 1539 Prestonvale Road, Part Lot 31, Concession 1, former Township of Darlington, for the purposes of a community park WHEREAS at its meeting on November 12, 2001, Council approved Report PSD-040-01 which recommended the enactment of this By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON ENACTS AS FOLLOWS: 1. THAT Council hereby authorizes an application to be made to the Council of The Corporation of the Municipality of Clarington as the approving authority under subsection 4(1) of the Expropriations Act, R.S.O. 1990, c.E.26, as amended, for the approval of the expropriation of all interests in the land described for municipal purposes in 2001 as 1539 Prestonvale Road, Courtice, Ontario which land is more particularly described in Schedule "A" attached and forming part of this By-law. 2. THAT Council hereby authorize staff to take all necessary actions to serve notice of its application for approval to expropriate upon the owners of the land to be expropriated and to publish the aforesaid notice in accordance with subsection 6(1) of the Expropriation Act. Joh Mutton, Mayor �Gr atti am unicipal Clerk SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Municipality of Clarington, in the Regional Municipality of Durham, formerly in the County of Durham, and being composed of Part of Lot Thirty-Three (33), Concession One(1) of the Geographic Township of Darlington,which parcel is more particularly described as follows: PREMISING that the bearing of the North limit of Lot 33, Concession 1, is North 74 degrees 00 minutes 00 seconds East and relating all bearings used herein thereto; COMMENCING at a point in the said Lot 33, which may be located as follows: BEGINNING AT THE NORTH-WEST ANGLE OF LOT 33, CONCESSION 1; THENCE North 74 degrees 00 minutes 00 seconds East along the said North limit of Lot 33, a distance of 347.55 feet; THENCE South 16 degrees 00 minutes 00 seconds East, a distance of 1,472.52 feet to the Point of Commencement; THENCE from the Point of Commencement North 83 degrees 13 minutes 00 seconds West to a point in the East limit of a travelled road passing through said Lot 33, a distance of 278.28 feet; THENCE South 6 degrees 17 minutes 20 seconds West along the said East limit of travelled road, a distance of 150.00 feet; THENCE South 83 degrees 13 minutes 00 seconds East a distance of 277.84 feet; THENCE North 6 degrees 27 minutes 30 seconds East, a distance of 150.00 feet more or less to the Point of Commencement.
