OF DARLINGTON OUR FILE: DEV 87-90, 18T-86068 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-9-88 be received; and 2. THAT the application submitted by Proctor and Redfern on behalf of Mr. Walter Schleiss and Mr. Raymond D. Holland to rezone a parcel of land located within Part of Lot 34, Concession 3, former Township of Darlington, from "Environmental Protection (EP)" to "Urban Residential Type One (R1)" be approved subject to the addition of a "Holding (H)" prefix and that the attached by-law hereto be forwarded to Council; and 3. THAT the attached by-law to rezone a parcel of land located within Part of Lot 34, Concession 3, former Township of Darlington from "Holding - Urban Residential Type One ( (H)Rl)" to "Urban Residential Type One (Rl)" zone be approved in principle and forwarded to Council at such time that the by-law amendment referred to in Recommendation No. 2 above is final and binding and the Subdivision Agreement between the Town of Newcastle and Walter Schleiss and Raymond D. Holland has been finalized; and i 4. THAT a copy of Staff Report PD-9-88 be forwarded to the applicant. i l . . .2 B890fy2 00. : 9D-9-88 D&QE 2 _______________________________________________________________________________ BACKGROUND AND COMMENT: On November 24, 1987 the Planning Department received a rezoning application submitted by Proctor and Redfern Group on behalf of Walter 8cbleiom and Raymond D. Holland to rezone a Pact of Lot 34' Cnooeoaiou 3, fncmaz Township of Darlington from "Environmental Protection (E9)11 to "Urban Residential Type One (Bl)« and to oeouudIy remove the "Holding (8)" prefix on a portion of the subject lands presently zoned "Holding - Urban Residential Type One ( (8)Rl)n to permit the development of thirteen (13) lots in o Plan of Subdivision (18T-86068) which was approved by Council at their meeting held on September 28, 1987. Staff would note that the subject site is designated as "Residential" within the Courtioe West Neighbourhood Development Plan. The proposal would appear to conform to this designation. Staff would note for Committee's information that pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate aigoage acknowledging the application was installed on the subject lands. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note that the following departments/agencies, in providing comments, offered no objections to the application as filed: - Region of Durham Planning Department - Region of Durham Works Department - Town of Newcastle Building Department - Newcastle Hydro Electric Commission - Town of Newcastle Fire Department - Regional Health Services - Ministry of Natural Resources - Town of Newcastle Community Services Department The Town of Newcastle Public Works Department in offering no objection to the rezoning, noted for the {oninittee'a information that aecvloeo are existing to service the proposed development. REPORT 00. : PD-9-88 PAGE 3 _______________________________________________________________________________ As noted previously, the subject lands are currently zoned as "Environmental Protection (EP)`' and "Holding - Urban Residential Type One ( (B)Rl), within the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. Section 3.9 within Zoning By-law 84-63 requires that prior to the removal of the "Holding" symbol, Council be satisfied that the oaeo to be permitted will be adequately serviced, the lands to be used have adequate access, prior oaea of the laud will not prevent the use of the lands for the purposes intended by the by-law, the proposed uses will be adequately protected from any physical or man-made hazard, and that the necessary agreements in respect of such matters and the associated financial requirements, where required, have been completed. In reviewing the rezoning application, Staff would note for the Committee's information that the comments received were similar to the comments provided for the subdivision review when it was initially circulated. In addition/ any coucmcua or conditions regarding the development were outlined by the draft conditions of approval as forwarded to the Regional Municipality of Durham for consideration. Given the above noted comments, Staff would have no objections to the approval of the rezoning application, however, as noted within Staff's recommendations, would request that the rezoning from "Environmental Protection (EP)11 to nDcbao Residential Type One (BI)" incorporate at this time n "Holding (B)" prefix. Pending Committee and Council's approval of same, the second by-law amendment as contained within Staff's recommendations to remove the (B) Holding symbol as it affects the entire thirteen (I3) lots would be forwarded to Council at such time that the preconditions as noted have been completed. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 114" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Environmental Protection (EP)" to "Holding - Urban Residential Type One ((H)Rl)" Zone as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
