THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2003- 077
being a by-law to authorize the MayoT and the Municipal Clerk to
execute an agreement between the Municipality of Clarington and
with the Owner and the Lessee of Parts 1 and 2 on Reference Plan
40R-2l874 as provided for in Resolution #C-290-03
WHEREAS at its meeting on May 12, 2003, Council passed Resolution #C-290-03 approving
the removal of the Holding (H) symbol from the lands which are Teferred to in the Planning
Services Department's File No. ZBA 2003-001 which are zoned Holding (H) M2 by Zoning By-
law 84-63, as amended, subject to certain conditions being satisfied including the making of an
agreement between the Municipality ofClarington and the Owner and the Lessee of Parts I and
2 on Plan 40R-21874 respecting a financial commitment by them to the cost of certain future
road improvements in the South Courtice Industrial Area;
AND WHEREAS the Owner and the Lessee have executed the said agreement;
NOW THEREFORE the Council of The Corporation of the Municipality of Cia ring ton enacts as
follows:
1. THAT the Mayor and the Municipal Clerk are hereby authorized to execute, on behalf of
The Corporation of the Municipality ofClarington, and seal with the Corporation's seal,
an agreement with the Owner and the Lessee of Parts I and 2 on Plan 40R-21874
respecting a financial commitment by them to the cost of certain future road
improvements in the South Courtice Industrial Area as provided for in Resolution #C-
290-03.

BY-LAW read a third time and fmally passed this 2nd day of June 2003,
