HomeMy WebLinkAbout2003-063 ~ CORPORATION OF THE MUNICIPALITY OF ClARINGTON BY-LAW NUMBER 2003- 061 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the former Town of Newcastle WHEREAS, the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of Newcastle in accordance with application ZBA 2003-008 to permit the construction of a single detached dwelling on private services; NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Section 12.4 "SPECIAL EXCEPTIONS - URBAN RESIDENTIAL TYPE ONE (R1) ZONE" is hereby amended by adding thereto, the following new Special Exception 12.4,57 as follows: "12.4.57 URBAN RESIDENTIAL EXCEPTION (R1-57) ZONE Notwithstanding Sections 12.1, 12.2 and 12.3, on lands zoned R1-57 on schedules to this By-law, a single detached dwelling, serviced by private water system and private sanitary waste disposal system which complies with the regulations of the Ministry of the Environment, shall be permitted subject to the following zone regulations: a) b) lot Area (minimum) lot Frontage (minimum) 7500 square metres 35 metres" 2. Schedule "13" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Urban Residential Exception (R1-2) Zone" to "Urban Residential Exception (R1-57) Zone ". 3. Schedule "A" attached hereto shall form part of this By-law. 4, This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Sections 34 and 36 of the Planning Act.
