BY-LAW 2002-198
being a by-law to authorize the execution of a
Memorandum of Agreement and a Minute of
Settlement with Ontario Power Generation Inc.
WHEREAS negotiations to settle assessment appeals by Ontario Power
Generation Inc. and the Municipality of Clarington respecting Darlington Nuclear
Generation Station for the years 1999, 2000 and 2001 as well as the taxation
implications for 2002 have been successfully concluded,
1. THAT the Mayor and the Municipal Clerk are authorized to execute
as Memorandum of Agreement on behalf of the Municipality with
Ontario Power Generation Inc. to settle assessment appeals and
taxation implications for the years 1999, 2000, 2001 and 2002
respecting Darlington Nuclear Generation Station.
2. THAT the Mayor and Municipal Clerk and authorized on behalf of
the Municipality of Clarington to execute a Minute of Settlement
with Ontario Power Generation Inc. to be filed with the Assessment
Review Board to implement the aforesaid settlement.
By-law read a first and second time this 2nd day of December, 2002
