HomeMy WebLinkAbout2002-149 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2002— 149 Being a By-Law to authorize a Letter of Agreement between the Corporation of the Municipality of Clarington and Ontario Minister of Transportation, to enter into an agreement regarding Ontario Transit Renewal Program. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington and seal with the Corporate Seal, a letter of agreement between the Ontario Minister of Transportation and said Corporation; and 2. THAT the letter of agreement attached hereto as Schedule "A"form part of this By-Law. By-Law read a first and second time this 30th day of September, 2002. By-Law read a third time and finally passed this 30th day of September, 2002. In consideration of the mutual covenants and agreements contained in this Letter of Agreement and the Guidelines and Requirements—Ontario Transit Renewal Program 2002(the"Guidelines and Requirements")which have been reviewed and are understood by the Municipality and are hereby incorporated by reference and other good and valuable consideration(the receipt and sufficiency of which is hereby acknowledged), the Ministry and the Municipality covenant and'agree as follows: 1. In recognition of the Municipality's need to replace ageing transit vehicles and the Municipality having entered into a binding agreement with a manufacturer for the purchase of such vehicles (the "Agreement"), the Ministry agrees to provide renewal funds to the Municipality in the amount of$5,128 (over 5 years= $25,640),in accordance with and subject to the terms set out in this Letter of Agreement and the Guidelines and Requirements. 2. The Municipality agrees that is shall provide a copy of the Agreement to the Ministry prior to the payment of any renewal funds by the Ministry under this Letter of Agreement and that the terms of the Agreement must comply with the requirements under the Guidelines and Requirements. V 3 The Municipality agrees that the renewal£ands are to be deposited in a capital reserve account by the Municipality and are to be used only in accordance with .;the Guidelines and Requirements. The Municipality understands and agrees that the renewal funds represent the full extent of the Ministry's and Province's financial contribution towards the major refurbishment and replacement of transit vehicles and that no additional funds will be provided by either the Ministry or the Province for such purposes to the Municipality for the year 2002. I have read and understand the terms of this Letter of Agreement, as set out above, and by signing below I am signifying the Municipality's consent to be bound by these terms.
