APPLICATION TO AMEND COURTICE NORTH NEIGHBOURHOOD DEVELOPMENT PLAN

PART LOT 30, CONCESSION 21 FORMER TWP. OF DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-82-88 be received; and
2. THAT the rezoning application and Courtice North Neighbourhood Development
Plan Amendment, submitted by WDM Consultants on behalf of Courtice Heights
Developments Ltd., to permit the development of a 1673 sq.m. (18,000
sq.ft.) commercial plaza, located in Part Lot 30, Concession 3, former
Township of Darlington, be referred back to Staff for a subsequent report
pending Staff's receipt of all comments from outside agencies; and
3. THAT the applicant's agent be so advised.
BACKGROUND AND COMMENT:
On January 25, 1988, the Planning Department received an application to amend the
Courtice North Neighbourhood Development Plan and the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, submitted by WDM Consultants on
behalf of Courtice Heights Developments Ltd. The subject applications seek to

develop a 1673 ag.m. (18r000 ag.ft.) retail commercial plaza, at the northeast
corner of 0aob Road and Trolls Road in Cooctioe.
The subject lands are currently designated as "Local Central Area'/ in the
Durham Regional official Plan and the Town of Newcastle Official Plan. Staff
would note for the Committee's information that the subject lands were
re-designated by Amendment 0o. 24 to the Darlington Township official Plan and
specified a maximum of 1673 aq.m. (18'000 oq.ft.) of retail and pecawoaI
service floor space. The application to re-designate the lands was made
Jouoazy' 1986, and accordingly, Staff forwarded DeDnzt PD-135-86 to the General
Purpose and Administration Committee Meeting of May 20, 1986 in respect of the

original application which proposed the development of 2'19I og.m. (23,585
oq.ft.) Local Central Area. In the Report, Staff identified a number of
problems with respect to site design and the potential impact on the designated
Community Central Area and other Neighbourhood Commercial sites in the
Courtine North Neighbourhood. Staff recommended that the applications be
referred back to Staff to permit further dialogue with the applicant.
Committee and Council resolved that the two (%) subject applications be denied
without prejudice.
Subsequently, a revised official Plan Amendment application was submitted,
proposing the development of a 2000 og.m. (2I,250 aq.ft.) Local Central Area.

In Staff Report PD-249-86' which was considered by Committee at its meeting of
October 20, 1986, Staff concluded that there was sufficient market opportunity
in the Cuortice North Neighbourhood to support the development of a Local
Central Area with a maximum area of 2000 og.m. . Accordingly, the Committee
approved PD-249-86, however, at the following Council meeting of October 27,
1986, Council denied the applications.
On February 25, 1987, the Regional Committee and Council approved the
proposals, forming Amendment 0o. 24. Subsequently, the General Purpose and
Administration Committee meeting of April 6, 1987, Committee had before them
Report PD-IO2-87 requesting Council to provide Staff with direction in the
matter of a referral of said amendment to the Darlington Township official Plan,

as approved by the Region of Durham to the Ontario Municipal Board, and at that
time the motion was lost, thereby endorsing Amendment 0o. 24. The Neighbourhood
Development Plan was not addressed at that time, however, and tboo Committee has
the amendment before them at this time.
The subject lands are presently zoned "Holding - Convenience Commercial ( (H)C2)"
in the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. Staff
would note that the zoning would have to be amended in order to reflect the
proposed uses.
Staff would note for the Committee's information that, pursuant to Council's

resolution of July 26' 1982 and the requirements of the Planning Act, the
appropriate aiguage acknowledging the application was installed on the subject
lands.
In accordance with departmental procedures, the applications were circulated to
obtain comments from other departments and outside agencies. The following
agencies offered no objection to the application as filed:
- Town of Newcastle Building Department
- Newcastle Hydro Electric Commission
- Docbom Regional Health Unit
- Ministry of Agriculture and Food

"This Department would note an objection to this application. It is of concern
to Oo bow this pact-time department (4 full time) will be able to maintain a
high level of service, given the amount of development in the municipality.
Should this application be approved it is recommended that no permits be issued
until anoeao routes are in accordance with Subsection 3.3.5.2(6) of the Ontario
Building Code. Also, adequate water supply should be available for firefighting
in accordance with Subsection 3.2.5.3 of the Ontario Building Code.
Building construction is to be in accordance with the Ontario Building and Fire
Codes."
Regional Planning and Regional Works
"This is in response to your request for comments of February 3, 1988 concerning
the above-noted proposed zoning amendment.

Regional Regional Planning and (
The subject property is designated "Residential" in the Durham Regional Official
Plan. Local Central Areas may be permitted in Residential areas subject to the
inclusion of appropriate designations and policies of the respective district
plans.
Amendment #24 to the Official PImu of the former Planning Area of the Io*oobip
of Darlington as approved by the Minister of Municipal Affairs on November lI,
1987 applies to the subject property. The purpose of the Amendment is to permit
the development of an 18,800 square font Local Central Area at the northeast
oozuec of TculI'a Road and Nash Road in the Couctice Urban Area. The proposed
rezoning to allow the new plaza appears to conform to the official Plan.
Regarding Regional service, municipal water supply and sanitary sewer service
are available to the subject site. The developer of the subject land will be
required to construct a sub-trunk sanitary sewer from Nash Road northerly to an

easement abutting the eastern boundary of the site. The developer will be
required to enter into a Servicing Agreement with the Regional Municipality
of Durham for the construction of the said sub-trunk sanitary sewer and all
other matters (financial and otherwise with respect to the provision of Regional
services."
Staff would note that comments are still outstanding from Town of Newcastle
Public Works and Community Services Department as well as from Central Lake
Ontario Conservation Authority.
In consideration of these outstanding comments, Staff would respectfully
recommend that the applications be referred bank to Staff for further processing
pending receipt of all comments.
