PART LOT 24, B.F.C., FORMER TOWNSHIP OF DARLINGTON OUR FILE: DEV 88-10 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-78-88 be received; and 2. THAT the application submitted by Miller Paving Ltd. to rezone a parcel of land located in Part Lot 24, B.F.C. , former Township of Darlington, be referred back to Staff pending the applicant's submission of the detailed Engineering Report as requested by Regional Planning Staff and the submission of the Site Plan pertaining to the proposal. BACKGROUND AND COMMENT: On January 19, 1988, the Planning Department received an application submitted by Robert Cumming on behalf of Miller Paving Ltd. to rezone a parcel of land within Part of Lot 24, Broken Front Concession, former Township of Darlington to permit the installation and operation of hot mix asphalt and ready mixed concrete batch plant with open storage for aggregates. . . .2 REPORT 00. : 9D-78-88 PJ&]D 3 _______________________________________________________________________________ The subject lands are designated as '`IudootciaI Areas" by the Region of Durham official Plan. industrial Areas shall be fully serviced by municipal water and sewage systems. However, limited development may take place prior to the availability of complete municipal services if the industry is of a dry nature. Within Zoning By-law 84-63' as amended, the subject lands are currently within the "General Industrial (M2)n zone. The subject lands comply to the minimum frontage and lot area of the 11y0211 zone for Iota serviced by a private well and a private sanitary waste disposal systems. In accordance with approved policy, the subject application was circulated to / various agencies and departments for comments. The following is a aqommcy of comments which have been received. The following departments/agencies had no objections: - Newcastle Building Department - Regional Health Services Newcastle Fire Department "This Department has no objection to the application. Fire response would be from Station Ifl' Bovmauville which is within the fine mile limit for insurance purposes. Water supply would be by Fire Department tank truck." Newcastle Public Works Department / "We have reviewed the above-noted application and recommend that this development should not proceed until such time as the following comments are dealt with: I. That the applicant's engineer prepares drawings in accordance with the requirements for site plan submission. The available sight distance for an industrial type entrance moot be determined to meet the minimum stopping sight distance for Baseline Road. 2. That all works are completed in accordance with the Town of Newcastle's Design Criteria and Standard Drawings. 3. That any easements required by the Town be granted free and clear of any encumbrances. 4. That a ].Om road widening be dedicated to the Town. That the developer will bear the costs (100%) of any works on Baseline Road which are necessitated as a result of this development (ie. turning lanes) . 6. That the developer meet all the requirements of the Public Works Department, financial or otherwise. 7. That the Owner enter into a Site Plan Agreement with the Town and that this department be kept informed of the status of same at all times. 8. All of the other standard requirements re: Lot Grading, Performance Guarantees etc. , should be included in the Agreement." Region of Durham Planning Department "Further to your request for comments, the site noted above is designated "Industrial Areas" in the Durham Regional Official Plan. Regional water and sanitary sewer services have not been extended to this property and are not planned to be installed in the foreseeable future. As a result, this proposal for an asphalt plant and concrete batch plant would need to be serviced privately. The proposed development may be permitted in the "Industrial Areas" designation provided that an Engineering Report is provided by a qualified engineer to the Regional and the local municipality, determining whether the proposed industry is of a "dry" nature and addressing the following matters per Section 8.4.3.2 of the Durham Regional Official Plan: - that there is an adequate supply of potable water; - that adequate temporary fire protection measures can be provided; and - that the soil is suitable for the installation of a waste disposal system which meets the Ministry of Environment's standards. We cannot establish the conformity of the subject application to the Durham Regional Official Plan until such time as the information listed above has been received and reviewed. Therefore, we request that this application be held in abeyance until the required engineering report is submitted by the applicant." . . .4 REPORT 00. : PD-78-88 PAGE 4 _______________________________________________________________________________ Ontario Hydro "To ensure that no adverse impacts occur to our existing easement located at the rear of the subject property, we request an opportunity to review the related site plan drawings prior to Council approving the subject %moiog By-law Amendment.11 It is noted for the Committee's information that Staff met with a representative of Miller Paving Ltd. on March 8' I988 noting the above couoecuo and further confirmed the Region's need for the Engineering Report and submission of a detailed Site Plan. ' Accordingly and in consideration of the above comments, Staff would request that the application be referred back to Staff pending the applicant's submission of the detailed Engineering Report and Site Plan.
