THAT Report PD -59 -88 be received; and 2. THAT the request submitted by Mr. H. Dean Ewart, Solicitor, on behalf of Eugene Construction requesting the transfer of 0.3 Metre Reserves abutting Land Division applications LD 337/87 to LD 441/87 inclusive, shown as Parts 9, 10, 11, 12 and 13, on Plan 1OR -2634, be approved; and 3. THAT the attached by -law authorizing execution of the Transfer of the 0.3 Metre reserves as described as Parts 91 10, 11, 12 and 13, on Plan 1OR -2634 be approved; and 4. THAT the Mayor and Clerk be authorized to execute the transfer of the 0.3 Metre Reserves as described within Recommendation No. 3 above; and 5. THAT the registration of the transfer documentation be completed at the expense of the Owner. ...2 REPORT NO.: PD -59 -88 BACKGROUND AND COMMENT: PAGE 2 It is noted for the Committee's information that the 0.3 Metre Reserve as referred to in the above -noted recommendation, was imposed as a condition of draft approval affecting Plan 1OM -784. Staff would confirm that the placement of the 0.3 Metre Reserve was initiated to preclude development on Block 84, Plan 1OM -784 until such time as appropriate applications have been submitted through the Land Division Committee for the creation of residential lots in compliance with the provisions of By -law 84 -63. Additionally, it was noted that the approval of any Land Division Committee applications would require the applicant providing the appropriate payments to the Town of Newcastle respecting lot development charges, cash -in -lieu of parkland payments, and cash contributions towards the construction of Penfound Drive fronting said lots. Staff would confirm that the appropriate Land Division applications have been filed and approved in consideration of the conditions imposed through the Land Division Committee process. To that end, Staff would confirm that the conditions of approval, respecting Land Division Applications LD 337/87 to LD 441/87 have been completed and the clearance letters forwarded to the Land Division Committee for their information, records and action thereon. In consideration of same, Mr. Dean Ewart, on behalf of Eugene Construction, has requested that the 0.3 Metre Reserves be transferred back to the corresponding lots as created through the Land Division process on the east side of Penfound Drive. Staff have reviewed same with the Public Works Department and would offer no objection subject to the completion of the necessary transactions and registration of same to be completed by the Owner. ...3 (M) REPORT NO.: PD -59 -88 PAGE 3 Accordingly and as noted within the Recommendations of said Report, Staff would have no objections to the transferring of the 0.3 Metre Reserves to each respective lot thereby providing access to Penfound Drive. FEB 17 1988 ll;z'*N O NIVZC.ASTLE PLANNING DE ARTMENT Re: Eugene Construction - Martin Road severances, LD335 - 339 and 440, 441/87, Part Block 84, Plan 1OM -784 Further to our discussion at your office on January 27th, enclosed please find three copies of five Deeds transferring the one foot reserve in front of these severed lots. Also enclosed please find one copy of Plan 1OR -2634. I have shown as consideration a value of $238.53 per lineal metre (Mitton, Region, letter of February 2, 1988, $141.01 for sewer and $97.52 for water) . Would you please arrange for these Deeds to be signed in black ink and return the original and one copy (both signed) to my office for registration. Please make sure that the names and positions of the persons signing on behalf of the corporation are printed below the respective signatures. The date of execution should be inserted at the right. The documents are signed in Box 8 on the two lines below the words "signature ". .. 2 The Town of Newcastle - 2 - Feb. 16 1988. As we discussed Eugene's sale transaction is set to close on April lst. I anticipate it will require at least one week to have the necessary Deeds stamped at the Land Division Committee. I would appreciate your doing whatever you can to make sure that the Deeds are returned to me within the next four to five weeks at the latest. Thank you very much for your co- operation.
