SUBJECT: REZONING APPLICATION - JOHN R. CUMMINS
PART LOT 30, CONCESSION 8, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-49-88 be received; and
2. THAT the attached by-law to amend By-law 84-63, as amended, be forwarded to
Council for approval.
BACKGROUND AND COMMENTS:
On Monday, February 1, 1988, the General Purpose and Administration Committee
endorsed the following resolution which was subsequently approved by Council at
their February 15, 1988 meeting:
"THAT Report PD-314-87 be lifted from the table and received; and
THAT the application submitted by Mr. John Cummins to rezone a 1.07
hectare parcel of land located in Part of Lot 30, Concession 8, former
Township of Darlington, be referred back to Staff for further dialogue
with the Ministry of Agriculture and Food."

As Committee may recall within Staff Report PD-314-87 (see attached) , Staff
noted that the Ministry of Agriculture and Food had requested that the
applicant submit the necessary justification pucnOmut to Section 3.14 of the
Foodlaud Guidelines in consideration of the request to expand the Hamlet
boundary limits of Enfield.
Based on additional diamoeaiwuo with Ministry Staff, and the acknowledgement
that the application was to be reviewed as a minor extension to an existing
Hamlet in aonocdoune with Section I0.4.1.4 of the Durham Regional Official
Plan, a further letter was received noting that the Ministry had no objections
to the minor expansion of the Hamlet.

Staff would note that comments contained within an earlier Report (PD-314-87)
reflected conditions which would be addressed through the Laud Division
Dzooeoo' should Committee and Council deem it appropriate to approve the
Rezoning Application as submitted. (i.e. owner contributing to the
reconstruction of Concession Road 0o. 9; submission of Lot Grading and Drainage
Plan; drainage easement to ensure positive roadside drainage through the
existing natural watercourse) .
In consideration of the above-noted comments and within Staff Report PD-314-87,
Staff would have no objections to the approval of the attached by-law amendment

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule 1119" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Agricultural Exception (A-1)" to
"Residential Hamlet (RH)" Zone as shown on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 35 of the Planning Act.
