THAT Report PD-42-88 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of February 4, 1988. This list includes the file number, applicant's name, site location, type of variance requested, Official Plan conformity, By-law conformity, Staff's comments on the applications, and the Committee of Adjustment's decision. Murdoch Member Arnold Reicheld Member Gordon Barrie Member Bernhard Heming Current Operations Planner Carlo Pellerin Secretary Marie Horne APPLICATIONS: A 5/88 - S & H Cronacher - Part Lot 34, Con. 2, Darlington Application was made for relief from zoning by-law requirements in order to permit the applicant to use the existing building for a commercial use, namely an eating establishment with take-out privileges, the existing lot having a frontage of 66.18 feet (20.17m) instead of the required 75m and an area of 22,000 sq. ft. (2043.8m2) instead of the required 7000m2, located in Part Lot 34; Concession 2, Darlington. Mr_. and Mrs. Cron)cher appeared in support of this application accompanied by Mr. D. Usbarne, Realtor. lir. J. Hallivay, Mr. E. Gearing and Mrs. F. Hicks were present in opposition to the application. No other person appeared in support of or in opposition to this application. Mr. & Mrs. James appeared in support of the application. No other person appeared in support of or in opposition to the application. Moved by Mr. Barrie, seconded by Mrs. Payne "THAT as the proposed application to create a parcel of land would appear to conform with the intent of the Official Plan and Zoning By-laws, and as the 85 acre parcel would still be larger than many other farms in the area, permission is therefore GRANTED to create an 85.5 acre (34.6ha) parcel of land instead of the required 100 acre (40. 47ha) parcel." Power, Part Lot 31, Concession 4, Darlington Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot with a frontage of 86 feet (26.2m) , instead of the required 301m and an area of 01.73 acres instead of the required 01.74 acre (3000m2) , located in Part Lot 31, Concession 4, Darlington. Mr. Power appeared in support of the application. Mr. D. Russell, Solicitor with the law firm of Worboy, Russell was present along with Mr. & Mrs. L. Wilbur in opposition to the application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Reicheld "THAT as the proposed lot would appear to conform with the intent of the Official Plan and Zoning By-laws and as the reduced width on the lot is compatable with other lots in the hamlet, permission is hereby granted to create a lot with a frontage of 86 feet (26.2m) .
