RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-33-88 be received for information.
BACKGROUND AND COMMENT:
On January 11, 1988 Staff received a letter from Dr. Mofeed Michael, Commissioner
of Planning for the Regional Municipality of Durham within which was referenced the
above-noted Plans of Subdivision and the Conditions of Draft Approval as issued.
To that end, it was noted that recently the Town of Newcastle Council recommended
draft approval of Plan of Subdivision 18T-87019. Included within the Conditions of
Draft Approval, two specifically dealt with the impact of the proposed developments
on existing wells in the surrounding area. Specifically the conditions stated that
prior to final approval of the plan, the owner agrees to initiate a comprehensive
well monitoring program in accordance with the Town's requirements. Secondly, the
subdivision agreement was to include assurances to the satisfaction of the Town of
Newcastle Public Works Department, that any reports of well interference attributed
to this development shall be immediately corrected to the satisfaction of the Town.
Said requirements shall include a provision to the effect that failure to satisfy

same will result in a bold being placed on Building Permits and/or a reduction
of any Letters of Credit.
Dc. Michael has indicated that in view of the many well interference complaints
in the Couctioe Urban Area, Regional Staff will impose similar conditions not
only on draft plan of Subdivision 18T-87019, but also on all existing and
future draft approved subdivisions in the Courtioe Area.
Furthermore, it was suggested that the Town may wish to request the Ministry of
Municipal Affairs to amend the Conditions of Draft Approval for two (2)

subdivisions in the Cnnctioe Urban Area (Files: 18T-76027 - Cooctioe South and
File: 18T-7604I - Peron) to incorporate similar conditions pertaining to
existing wells.
Staff would note for the Committee's information with respect to the first Plan
of Subdivision as noted, the developer has provided a raob contribution in
respect of same. Staff would note that Plan I8T-70041 and the accompanying
Subdivision Agreement incorporates provisions pertaining to any damages to
neighbouring wells. Accordingly, and in view of the fact the plans are
entirely or partially registered, we see no advantage in requesting the
suggested modifications.

UD December 14, 1987, Town Of Newcastle COWOCfl recommended draft
approval Of plan Of subdivision 18T-87019 subject to various
conditions. Two Of the conditions dealt with the impact Of the
proposed development on existing wells in the surrounding area and
these COnditf0O3 read as follows:
20. That prior t0 final approval of the Plan, the Owner agrees to
initiate 8 comprehensive well monitoring program in
accordance with the ToNO/3 requirement.
21 . That the subdivision agreement include assurances, t0 the
satisfaction of the TONO Of Newcastle Public Works

Department, than any reports Of well interference attributed
to this development shall be immediately corrected to the
satisfaction of the Town. Said requirement shall include a
provision to the effect that failure to satisfy same will
result in a hold being placed On building permits and/or
reduction of any Letter/s\ of Credit.
In view Of the many well interference c00pl8fOtS in the C0urtfc8
Urban Area, we will impose such conditions not only on draft plan
18T-87019 but also UD all existing and future draft-approved
subdivision plans in the COUrtiC8 Area.
In COn 'UOcti0D with our efforts, we also Suggest that the Town
request the Ministry of Municipal Affairs t0 amend the conditions
of draft approval for two subdivision plans in the CoUrtiC8 Area

(Files 18T-76027 and 18T-77041 ) to incorporate similar conditions
pertaining to existing wells.
