OF CLARKE OUR FILE: DEV 87-97 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-32-88 be received; and 2. THAT the application submitted by Christopher Robinson and Lynne Lowery- Robinson to rezone a parcel of land located in Part Lot 29, Concession 5, former Township of Clarke, be referred back to Staff pending the applicant's submission of a detailed Engineering Report as required pursuant to the provisions of the Town of Newcastle Official Plan. BACKGROUND AND COMMENT: On November 16, 1987, the Planning Department received an application submitted by Christopher Robinson and Lynne Lowery-Robinson to rezone a parcel of land within Part of Lot 29, Concession 5, former Township of Clarke to permit the development of eight (8) additional non-farm residential lots on private sanitary waste disposal systems and private wells. . . .2 / *\ / REPORT 0D. : PD-32-88 PAGE 2 ------------------------------------------------------------------------------- The subject lands are designated as a Hamlet in the Regional official Plan. Residential development obaII be limited to minor internal iufilliug and/or minor additions to existing development. By-law 84-53, as amended, obovvo the subject lands currently within the "Urban Residential Type One Special Exception (Bl-2)" and "Agricultural (A),. The (Dl-3) zone permits residential buildings and otrootocea on Iota which predate the current Zoning By-law or on Iota with a minimum lot area of 695 square metres and a minimum lot frontage of 20 metres. Furthermore, no building or structure may be erected and no use may be established in this zone ouleaa the . lot is serviced by municipal water and an approved private aouitocy waste disposal system. Staff *noId note the application proposed private services. In accordance with approved policy, the subject application was circulated to various agencies and departments for comments. The following is a summary of comments which have been received. The following departments/agencies had no objections: - Town of Newcastle Fire Department - Town of Newcastle Building Department - Gauacmoha Conservation Authority - Ministry of Agriculture and Fund - Peterborough-Victoria-Northumberland and Newcastle Separate School Board ' The following comments were provided as follows: Town of Newcastle Public Works Department "We have reviewed the above-noted application and prior to this development proceeding, the following comments should be dealt with: l. That the Owner be responsible for providing street lighting along Main Street in accordance with Town Policy; 3. That the Owner will contribute (1000) of the costs of constructing a sidewalk along Main Street; 3. That the Owner enter into a Development Agreement with the Town and that this Department be kept informed of the status of same at all times; 4. That all works are completed in accordance with the 7ovmz of Newcastle Design Criteria and Standard Drawings; B8P0DT 00. : PD-32-88 PAGE 3 fif(K) ------------------------------------------------------------------------------- Town of Newcastle Public k ( 5. That the Owner meet all the requirements of the Public Works Department, financial and otherwise; G. All of the other standard requirements re: Lot Grading, Schedule of Works, Performance Guarantees, Coot Estimates etc., should be included in Development Agreement." 9onvo of Newcastle Community Services tme t "Please mbe advised that the Community Services Department has no objection to the above application. Z would, however, require cash-in-lieu of 5# parkland dedication. . . .n . Regional Health Services "The above application for rezoning has been investigated by this Health Department and there is no objection to the rezoning, however, this Department will require the following prior to severance or subdivision approval: a) development site plans; b) Inta to be graded to the east eliminating the valley in the middle of the lots; o) individual drilled wells to be installed in the front yards; and d) tile beds to be installed in the rear yards." Region f Durham Planning tme t ' ". . .The subject property is located in the vicinity of Orono, which is designated as a Hamlet in the Regional official Plan and the Town of Newcastle official Plan. In both Plans, residential development shall be limited to minor internal lofiIliug and/or minor additions to existing develo[mueut. The proposed use of the subject property may therefore, be permitted. The creation of a 20 metre frontage for the portion of the property that is to remain zoned "Agriculture", should perhaps be reviewed. This frontage may appear to commit the Town to, not only a road at this location but also further expansion of the Hamlet in this area. Such a commitment, in the absence of a development plan for the Hamlet of Orono, would be DcmmatOca^ In addition, we have not yet completed our examination of the servicing implications of the proposal. When this examination is completed, we will provide you with additional comments. . . .' . . .3 REPORT NO. : PD-32-88 PAGE 4 ------------------------------------------------------------------------------- The Town of Newcastle official Plan requires development applications to be accompanied by a detailed Engineering Report based on teat drilling which demonstrates the following: - soil conditions satisfactory for the effective operation of a private waste disposal system; - no adverse effects upon existing water ooDpIieo and an adequate supply of potable water to service the proposed development; - an adequate separation distance between wmtectable and septic tile fields. This Report, uDuu submission, must be forwarded to the Region of Durham Health Department and the Ministry of the Environment for their review and comment. Staff would note that the applicants have been informed of this requirement. Currently, municipal water is not available to the subject property. The Regional Public Works Department has previously indicated that capacity only exists in the existing municipal water system to serve an additional sixty (68) units. As well, the Department has indicated a concern with respect to the quality of water available through the municipal system and has indicated that additional information on water quality will be forthcoming. ' As Committee is aware, Council has recently approved a resolution, thereby requesting Staff to prepare the necessary terms of reference for the hiring of a consultant to prepare Hamlet Plans for Hampton and Orono. Staff would note that in consideration of same, several quotes have been received, and a recommendation will be forthcoming. Notwithstanding the above comments and status of the Hamlet Plan, Staff would note as contained within the Newcastle official Plan, an Engineering Report is to be submitted as supporting documentation to the rezoning application.
