SUBJECT: REZONING APPLICATION - MOLLENHAUER PROPERTIES LTD.
PART LOT 35, CONCESSION 2, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-29-88 be received; and
2. THAT the by-law attached hereto amending By-law 84-63, as amended, be
forwarded to Council for approval.
BACKGROUND AND COMMENT:
As Committee may recall, at the General Purpose and Administration Committee
Meeting held on January 18, 1988, in consideration of Staff Report PD-17-88, a
resolution was approved requesting that DEV 87-91 be referred back to Staff for the
preparation of a by-law amendment. To that end and in consideration of Committee's
recommendation, the by-law amendment attached hereto, rezoning the subject property
from "Special Purpose Commercial (C5)" Zone to "General Commercial (Cl)" Zone, is
submitted for Committee and Council's consideration.

Staff would acknowledge that the development of the subject properties would
require the approval of a Site Plan Agreement prepared in compliance with the
provisions of the /`Clx zone within By-law 84-63.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOVI THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows;
1. Schedule 114" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Special Purpose Commercial (C5)" to
"General Commercial (Cl)" as shown on the attached Schedule "X" hereto.

2.` Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 34 of the Planning Act.

1988.
