RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-27-88 be received; and
2. THAT the request submitted by Mr. Lawrence Wesson, Solicitor, on behalf of
Schickedanz Bros. Ltd. and Veltri and Son Limited thereby exempting Lots 1
to 49 (inclusive) , as shown on Plan 1OM-800 from Part Lot Control, be
acknowledged; and
3. THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49, Subsection (7) of the
Planning Act; and
4. THAT Mr. Lawrence Wesson be so advised.
BACKGROUND AND COMMENT:
On January 15, 1988, Staff received a request from Mr. Wesson, acting on behalf of
Schickedanz Bros. Limited and Veltri and Son Limited, for an exemption from Part
Lot Control in respect of Lots 1 to 49 (inclusive) as shown on registered Plan

1OM-800. Staff have reviewed the request and would have no objection to name
and the approval of the by-law exempting the subject lands within this pIuu
from Part Lot Control. Staff would confirm that the Subdivision Agreement and
the subsequent Plan (10M-800) have been registered on title in consideration of
the appropriate approvals to permit the development of said lands.
In that regard, attached herewith is a by-law which requires approval of
Council and the Regional Municipality of Durham which would exempt the subject
lauds from Section 49(5) of the Planning Act pocooaut to the provisions of
Section 49(7) of said Act.
Accordingly and in order to facilitate conveyance of title of the individual

semi-detached dwelling units located on these lots, it would be appropriate for
the Council to approve the necessary exemption from Part Lot Control.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to designate a certain portion of a registered plan as not being
subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Lots 1 to 49 (inclusive) of Plan
1OM-800, registered at the Land Registry Office for the Land Registry Division
of Newcastle (No. 10) on December 8, 1987.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. THAT Subsection (5) of Section 49 of the Planning Act shall not apply to
those lands described in Schedule "A" attached to this By-law.
2. This By-law shall come into effect upon being approved by the Regional
Municipality of Durham and thereafter Subsection (5) of Section 49 shall cease
to apply to the lands described in Schedule "A" attached hereto.
3. Schedule "A" attached hereto shall form part of this By-law.
