OF DARLINGTON OUR FILES: DEV 87-92, 18T-86009 AND OPA 86-11/D RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-26-88 be received; and 2. THAT the application submitted by Carl and Joseph Schwarz to rezone a parcel of land located within Part of Lot 22, Concession 2, former Township of Darlington to implement the development of a seven (7) lot estate residential subdivision be approved and that the by--law attached hereto be forwarded to Council for approval; and 3. THAT a copy of Staff Report PD-26-88 be forwarded to the applicant. BACKGROUND AND COMMENT: On November 9, 1987 the Planning Department received a rezoning application submitted by Carl and Joseph Schwarz to rezone a parcel of land in Part of Lot 22, Concession 2, .former Township of Darlington from "Agricultural (A) " to "Residential Estate (RE)" to permit the development of a seven (7) lot Plan of Subdivision (File: 18T-86009) which was approved by Council at their meeting held on October 19, 1987. . . .2 REPORT NO. : PD-26-88 PAGE 2 ------------------------------------------------------------------------------- As Committee may recall, the site was previously subject to an Official Plan Amendment to permit the Plan of Subdivision. This development application was given approval by the Minister of Housing on June 2, 1987. Staff would note for the Committee's information that, pursuant to the Council resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. Furthermore, in accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note that the following departments/agencies, in providing comments, offered no objection to the application as submitted. - Region of Durham Planning Department - Region of Durham Public Works Department - Region of Durham Health Unit - Newcastle Public Works Department - Newcastle Community Services Department - Newcastle Building Department - Newcastle Fire Department - Ontario Hydro - Central Lake Ontario Conservation Authority reviewing the rezoning application, Staff would note that the comments aceived were similar/consistent to the comments provided for the Subdivision review when it was initially circulated. Furthermore, any concerns or conditions of approval regarding the development were outlined by the draft conditions of approval as forwarded to the Regional Municipality of Durham for their consideration. Subsequent thereto, the Commissioner of Planning for the Region of Durham issued the Conditions of Draft Approval on December 4, 1987. Staff would note for the Committee's information that a letter in opposition to the rezoning application, as a result of the circulation of same, was received by Staff. An adjacent landowner commented to the effect that they wish to state that they were opposed to the development of the parcel of land and that the main concern is the effect that wells would have on the water level within their own well. Staff would note for the Committee's consideration that, within the conditions of draft approval as issued, Condition Numbers 7 & 8 . . .3 i� REPORT 0O. : PD-26-88 PAGE 3 _______________________________________________________________________________ stated as follows: 117. That the Ovmnec shall submit to the Ministry of Environment a Hydrologist's Report which ascertains the availability of an adequate supply of potable water to service the development. The Report shall also comment on existing quality based on data from a representative well as well as the potential of cross-contamination and well interference. 8. Prior to final approval of the Plan, the Owner obaII complete, to the satisfaction of the Central Lake Ontario Conservation Authority, an Engineering Hydrology Report for the subject lands which details soil otcatigrapby identifies environmental constraints on the uses of private sewage disposal systems and makes recommendations to minimize adverse impacts on and off the site." Staff would additionally note that within the terms of the Town of Newcastle Subdivision Agreement, Section 5,19 specifically makes reference to the Owners/Developers responsibilities in considering any damages or relocation of existing services or neighbouring wells as a result of the development. In consideration of the above-noted comments and approvals as received for official Plan Amendment and proposed PIoo of Subdivision, the By-law attached hereto as described within Staff's recommendations is submitted for Committee and Council's consideration. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 1118" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Residential Estate (RE)" as indicated on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
