THAT Report PD-24-88 be received; and 2. THAT the Ganaraska Region Conservation Authority be advised that the Town of Newcastle is currently involved with the Shoreline Property Assistance Program, and anticipates this involvement to continue for the foreseeable future; and 3. THAT the Ganaraska Region Conservation Authority be requested to appoint its Water Resources Engineer to act as the Town's inspector for works undertaken through the Program; and 4. THAT a copy of Staff Report PD-24-88 and Council's decision be forwarded to the Ganaraska Region Conservation Authority. BACKGROUND: On June 8, 1987, the Town received a letter (attached) from the Ganaraska Region Conservation Authority in regards to the Shoreline Property Assistance Program. As . . .2 REPORT 00. : PD-24-88 PAGE % _______________________________________________________________________________ indicated by the letter, the program is intended to provide financial assistance to property owners along the Lake Ontario shoreline who are experiencing flood and/or erosion damages. The Conservation Authority has requested the Town to advise of our present or anticipated future involvement in the Shoreline Property Assistance Program. COMMENT: The Shoreline Property Assistance Program requires a municipality, as a condition of participating in the Program, to pmaa a by-law approved bv the � � Ontario Municipal Board uotbucimiug the sale of debentures to the Province. This nlIuwo a municipality to borrow money from the Provincial Government which, in turn, vmoId be lent to individual property owners seeking assistance. The Town passed a debeoturiog by-law in 1974 and, in I980, authorized a loan of $18'000. to o shoreline property owner through By-law 0o. 80-8I. This is the only loan which has been authorized under the Program. In 1986' Council passed By-law 0o. 86-28v which has been approved by the Ontario Municipal Board, to increase the money available under the Program to $185,000. The Shoreline Property Assistance Program also requires a municipality to appoint a competent Inspector. Mrs. Heather Rutherford, the Chief ( Administrative Officer of the Qauaraoka Region Conservation Authority, has advised Town Staff that the Authority's Water Resources Engineer fulfills this function for other municipalities and that the Authority would appoint this person to serve as the Town's inspection engineer if so requested. It is therefore respectfully recommended that the Gauacaaka Region Conservation Authority be advised that the Town of Newcastle is currently involved with the Shoreline Property Assistance Program and anticipates this involvement to continue for the foreseeable future. Through this program landowners are advised of the most effective means of addressing these problems on a site specific basis. Although actual construction costs are the responsibility of the landowner, low interes± loans are available sander the Shoreline Property Assistance Program, sponsored by. the Ministry of Muill cipal Affairs and administered a by the local municipality. A shoreline municipality may participate in the program only after passing a by-law approve6 by the Ontario Municipal Board authorizing the sale of debentures to the Province. Because the Conservation Authority will be making recommendations for shoreline protection works on private properties within the Tcwp of Newcastle, there may also be some inquiries regarding the avG.-'i,.a')i';ity of financial assistance through the municipality. We would t'lerefore appreciate being advised of the Town's present or antic gated future involvement in the Shoreline Property Assistance Program. For your information, please find enclosed a fact sheet describing the programs available to municipalities from the Ministry of Municipal Affairs. Yours truly, �t T' Heather Rutherford (Mrs. ) Chief Administrative Officer HR/jml j Encl . 1 {MINISTRY OF MKINICIPAL AFFAIRS SHORELINE PROPERTY ASSISTANCE PROGRAM 1) General - Loans are available for the repair or protection of privately- owned shoreline lands and structures which have been damaged or eroded by high water levels in the Great Lakes system. - The loans bear interest at 8% and are repayable over 10 years through property taxes. - The maximum loan for shoreline protection is the lesser of 75% of the cost or $500 per metre of shoreline - The maximum loan for building repairs is the lesser of 75% of the cost or $200000. The loans are available for structural repairs only, not repairs to contents. - Amendments are now being drafted to allow loans in unorganized areas and to allow loans for raising or relocating structures to prevent damages from occurring. 2) Preliminary Steps - Municipality must pass a by-law, approved by the Ontario Municipal Board, authorizing the sale of debentures. - Municipality must appoint a "competent" inspector. Some municipalities use a staff member, but most use a consulting engineer. 3) Application for Loan - Application must be made to the municipality in which the property is located. - Mortgagees and other encumbrances are notified and given two weeks to object to the loan. - The inspector determines that the work is necessary and that it will have no adverse effect on adjacent properties. - Council approves the application, and the work proceeds. - The inspector inspects the completed project and files an inspection and completion certificate with the clerk. 4) Processing the Loan - Council passes, and the clerk registers on title, a by-law imposing a special annual rate for repayment of the loan. . . ./2 tv 2 - - The debenture, the by-law, an offer to sell , and copies of the inspection certificates are forwarded to the Subsidies Branch. - Debentures are dated and purchased on the first of each month. - Loans may be prepaid in full► at any time with no penalty. - The loans are deemed to be taxes and the normal procedures for non-payment of taxes can be followed in case of default. % to) I r MINISTRY OF MUNICIPAL AFFAIRS SPECIAL ASSISTANCE - Grants may be provided when extraordinary costs unforeseen by council will result in an undue increase in property taxes. - Costs must be incurred for emergency repairs to essential municipal infrastructure. - All other sources of funding (eg. M.T.C. , O.M.A.F. , M.O.E. ) must first be exhausted. - No assistance will be provided until the work has been done, the residual cost to the municipality has been identified, and the effect on property taxes has been determined. - Application should be made to the appropriate field office of the Ministry of Municipal .Affairs.
