LIMITED PART LOT 30, CONCESSION 1, FORMER TWP. OF CLARKE OUR FILE: DEV 87-98 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-23-88 be received; and 2. THAT the attached by-law to rezone a parcel of land located within Part Lot 30, Concession 1, former Township of Clarke from a "Holding - Urban Residential Type One ( (H)Rl)" to "Urban Residential Type One (Rl)" zone be approved in principle and forwarded to Council at such time that the Subdivision Agreement between the Town of Newcastle and Penwest Developments Corp. Limited has been finalized; and 3. THAT a copy of Staff Report PD-23-88 be forwarded to the applicant. BACKGROUND AND COMMENT: On November 17, 1987, the Planning Department received a rezoning application i submitted by Tunney Planning on behalf of Penwest Development Corporation Ltd. to rezone Part of Lot 30, Concession 1, in the Village of Newcastle. The application seeks the removal of the "Holding (H)" prefix on the subject lands presently zoned I . . .2 REPORT NO. : PD-23-88 PAGE 2 ------------------------------------------------------------------------------- "Holding - Urban Residential Type One ( (H)Rl)" to permit the development of 181 residential dwellings as proposed in Plan of Subdivision 18T-87002, which received draft approval by Council at their meeting of November 23, 1987. Staff would note that the subject site is designated as "Residential" within both the Durham Regional official Plan and the Newcastle Village Small Urban Area official Plan. The proposal appears to conform with this designation. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note that all comments received indicated no objection to the rezoning, except the Town of Newcastle Public Works Department. They have indicated that a Site Servicing Report for this development should be received and approved for implementation by the Director of Public Works, prior to their recommending approval of the rezoning. Planning Staff note that within the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, Section 3.9 requires that, prior to the removal of the "Holding (H)II symbol, Council be satisfied that the uses to be permitted will be adequately serviced, the lands to be used have adequate access, prior uses of the land will not prevent the use of the lands for the purposes intended by the By-law, the proposed uses will be adequately protected from any physical or man-made hazard, and that the necessary agreements in respect of such matters and the associated financial requirements, where required, have been executed. In reviewing the rezoning application, Staff would note for the Committee's information that Public Works' concern is similar to comments provided for the Subdivision review during its circulation. In addition, these concerns regarding development were incorporated in the conditions of draft approval as forwarded to the Region of Durham for consideration. 3 REPORT 00. : PD-23-88 PAGE 3 _______________________________________________________________________________ Given the above-noted oonmvsutav Staff would have no objections to the approval of the rezoning application, however, as noted within Staff's recommendations, the by-law amendment to remove the " (B) Boldiug'^ symbol from the subject lands be forwarded to Council at such time that the above-noted pre-conditions are fulfilled and the Subdivision Agreement has been executed and registered on title. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "5" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)" Zone as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
