FOR THE MEETING OF JANUARY 6, 1988
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
l. THAT Report PD-22-88 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
prepared the attached list of applications to the Committee of Adjustment for the
meeting of January 6, 1988. This list includes the file number, applicant's name,
site location, type of variance requested, official Plan conformity, By-law
conformity, Staff's comments on the applications, and the Committee of Adjustment's
decision.

APPLICATIONS:
A 1/88 - G & H Vandergaast - Part Lot 34, Con. 2, Darlington
Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage of
12.2m, instead of the required 15m frontage.
G. Vandergaast and H. Vandergaast appeared in support of this
application. Mr. & Mrs. R. Renions, Mr. L. Saunders and Mr. &
Mrs. Dawson were present in opposition to the application. No
other person appeared in support of or in opposition to this
application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT as the requested variance would not be considered
desirable for the appropriate development of the land,
and would be setting a precedent for future development
in this area, therefore the variance is not considered
minor and is DENIED."

A 2/88 - W. & E. Allin, Part Lot 19, Concession 2, Clarke
Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage
of 77.5 ft. (23.6m) , instead of the required 30m frontage.
Mr. & Mrs. W. Allin appeared in support of the application. No
other person appeared in support of or in opposition to the
application.
Moved by Mrs. Payne, seconded by Mr. Reicheld
"THAT as the requested variance would appear to conform
with the intent of the Official Plan and Zoning By-law
and would be appropriate for the development of the land
and area, the variance is considered minor in nature
and is therefore GRANTED to create a lot with a frontage
of 77.5 ft. (23.6m) ."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage
of 77.5 ft. (23.6m) , instead of the required 30in frontage.
Mr. & Mrs. Allin appeared in support of the application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Reicheld
"THAT as the requested variance would appear to
conform with the intent of the Official Plan and
Zoning By-law and would be appropriate for the
development of the land and area, the variance is
considered minor in nature and is therefore GRANTED
to create a lot with a frontage of 77.5 ft. (23.6m) ."

A 4/88 - Walter Michalejko, Part Lot 11, Concession 1, Bowmanville
Application was made for relief from zoning by-law requirements
in order to permit the applicant to construct a semi-detac'ed
dwelling on a lot with an area of 496m2 leaving a front yard of
14 ft. (4.2m) , instead of the required area of 550m2 and front
yard of 6m.
Mr. Michalejko appeared in support of this application. Verna
Hooey, June Clark and John Gauthier appeared in objection to the
application. Mr. Gauthier stated that he objects to the smaller
lot as he feels it would be setting a precedent. No other person
appeared in support of or in opposition to the application.
Moved by Mr. Murdoch, seconded by Mr. Rehder,
"THAT as the requested variance would not offend the
intent of the Official Plan or Zoning By-law and would
not appear to have a detrimental effect on the surround-
ing neighbourhood and as the setback along Wellington
Street would appear to be similar to the requested
setback and is therefore considered minor in nature,
permission is GRANTED to construct a semi detached
dwelling on a lot with an area of 496m2 leaving a
front yard of 4.26m (14 feet) ."

Moved by Mr. Murdoch, seconded by Mr. Rehder
"THAT application no. A 88/87 be deferred until such
time as the applicant submits an amended plan showing
the size of all the accessory buildings."

"THAT the minutes of the last meeting be approved as
circulated."

Appeal date for the foregoing applications is February 5, 1988
