SLRJECT: REZONING APPLICATION - L. STANEK (LIBBYWOOD ESTATES)
PART LOTS 31/32, CONCESSION 4, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-15-88 be received; and
2. THAT Rezoning Application DEV 87-86 submitted by Michael Armstrong be
referred back to Staff for further processing until such time as the
Official Plan Amendment and Plan of Subdivision (18T-87074) applications
have been given due consideration; and
3. THAT a copy of Council's decision be forwarded to the applicant and the
interested parties indicated hereto.
BACKGROUND AND COMMENT:
On October 26, 1987, the Town of Newcastle Planning Department received an
application to rezone approximately an 8.0 hectare parcel of land in Part Lots 31
and 32, Concession 4, former Township of Darlington just north of the Courtice
Urban Area. The subject lands are presently zoned "Agricultural (A) " and
"Environmental Protection (EP)". The application seeks to rezone the site to
permit Estate Residential development.

The subject lands are also under applications OIA 87/74 for an Official Plan
Amendment and (18T-87074) for subdivision approval. This proposal would create
ten (10) Estate Residential lots.
The rezoning application has been circulated to various agencies for comment.
To date all but six (G) departments/agencies have commented on the rezoning and
subdivision application. The Regional Health Department, Northumberland and
Newcastle Board of Education, Newcastle Hydro Electric Commission, Newcastle
Building Department and Trnoo-0mrtbeco Pipelines all indicated they had no
objection to the rezoning.
Some of the comments received were as follows:

"No objection to the applications. Would require 5% cash-in-lieu of parkland
dedication."
Town of Newcastle Fire Department
"This Department would note an objection to the above-noted application. This
part-time Fire Department (4 full-time firefighters) will not be able to
maintain the existing level of service, considering all of the development that
is taking place throughout the Municipality."

Planning Staff note the proposed subdivision may require redesigning as not all
the lots omnDIy with the minimum lot area requirements for "Estate Residential"
zone.
In consideration of the foregoing comments and submission of the appropriate
Official Plan Amendment and Plan of Subdivision applications, it is
respectfully recommended that Rezoning Application DDV 87-86, submitted by
