SUBJECT: PROPOSED BY-LAW AMENDMENT
PART LOT 11, CONCESSION 1, FORMER TWP. OF CARTWRIGHT
HAMLET RESIDENTIAL - EIGHT (8) LOTS
FILE: PLN 3.2.2
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-13-88 be received; and
2. THAT the Council of the Township of Scugog be advised that the Corporation
of the Town of Newcastle has no objections to the proposed Zoning By-law
Amendment to permit the development of eight (8) single family dwelling
lots; and
3. THAT the Council of the Township of Scugog be advised that the Town of
Newcastle would request that, prior to the issuance of any building
permits or access permits for the eight (8) lots, the Owner shall satisfy
the requirements of the Town of Newcastle Public Works Department in
respect of the boundary road and all works related thereto.
BACKGROUND AND COMMENT:
It is noted for the Committee's information that the Planning Department received a
Public Meeting Notice from the Township of Scugog acknowledging that an application
had been submitted by Mr. Noel to rezone his lands to permit the development of

eight (8) single family lots. The subject lands are located on the north side
of the boundary road between the Town of Newcastle and the Township of Scugog
within Part of Lot 11, Concession 1, Ward 4, in the former Township of
Cartwright (see attached key map) .
Staff would note that the lands to the south of the proposed parcel within the
Town of Newcastle are zoned "Residential Hamlet (RH)". In reviewing the
application, Staff would note that the Town of Newcastle Public Works
Department have offered the following comments:
"l. Based upon the information submitted it is unclear as to the limits of
rezoning abutting the maintained portion of Boundary Road. If the limits
extend west of the maintained portion the Owner would be responsible to
bear the costs (100%) of constructing Boundary Road and altering the
Turning Tee in accordance with the Town of Newcastle's Design Criteria
and ,Standard Drawings.
2. The long embankment on the north side of Boundary Road presents a problem
for access to the proposed lots. The Owner shall present lot grading
plans that address this situation.
3. That any road widenings deemed necessary by this Department be dedicated
free and clear of all costs to the Town of Newcastle.
4. That the Owner contributes to the recovery costs of the previously
constructed Boundary Road fronting the subject lands.
5. THAT the Owner enters into a Development Agreement with the Town and that
this Department be kept informed of the status of same at all times.
6. That the Owner meet all the requirements of the Public Works Department,
financially and otherwise.
7. All of the other standard requirements re: Lot Gradiang, Schedules of
Work, Performance Guarantees, Cost Estimates etc., should be included in
the Development Agreement."
As Committee may recall, an amendment to the existing Boundary Road Agreement
with the Township of Scugog in respect of maintenance of the Boundary Road was
recently considered and approved by Committee and Council. The necessary
amendment in effect realigned the responsibilities of each municipality noting
that the Township of Scugog would be responsible for maintenance of the
Boundary Road from Regional Road No. 57 easterly and the Town of Newcastle for

that portion west of Regional Road 0o. 57.
Inasmuch as the Rezoning Application presently submitted to the Township of
Scugog is located westerly of Regional Road 0o. 57' Staff would request, as
noted within the recommendations of this Report, that prior to the issuance of
any building permits or access permits for the eight (8) Iota, that the Owner
shall satisfy the zeguicameoLo of the Town of Newcastle Public Works Department
in respect of the 8000dozy Road and all works related thereto.

Re: Boundary Road Agreement, Scugog & Newcastle
Dear Mr. Oakes :
At the last regular meeting of the Council of the
Township of Scugog, the existing arrangement with respect to
maintenance of the boundary road was discussed at some
length.
The Scugog Road Superintendent, Mr. MacDonald,
suggested that as a result of additional development
occuring on the boundary on the Newcastle Side, there should
be some realignment of responsibility and suggested that the
Township of Scugog assume responsibility for the boundary
from Regional Road 57 easterly and that your Municipality
look after that section to the west.
I would appreciate it if you could present this
proposition to your Council for their concurrence and then
the formal documents can be prepared.
