HomeMy WebLinkAboutPD-11-88 DN: 11-88 TOWN OF NEWCASTLE REPORT f, File # -3,r, � Res. # 8y-Law # MEETING: General Purpose and Administration Committee DATE: Monday, January 18, 1988 REPORT #: PD-11788 FILE #: DEV 87-95, OPA 87-81/N & 2.2.1(7) SUBJECT: REZONING APPLICATION - DEV 87-95, NEIGHBOURHOOD DEVELOPMENT PLAN AMENDMENT - 2.2.1(7) AND OFFICIAL PLAN AMENDMENT - 87-81/N TOWNLINE CENTRE INC. - PART LOT 35, CONCESSION 2, DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-11-88 be received; and 2. THAT the application filed on behalf of Townline Centre Inc. be referred back to Staff until such time as the Official Plan Amendment applications have been given due consideration. BACKGROUND AND COMMENTS: On November 9, 1987, the Planning Department received an application submitted by Kathryn Harrison of Jones & Jones on behalf of Townline Centre Inc. to rezone a 0.48 ha parcel of land located in Part of Lot 35, Concession 2, former Township of Darlington to permit the development of two (2) one storey retail commercial buildings with a total area of approximately 4,700 square metres. The subject site isx designated "Residential Areas" within the Region of Durham Official Plan. . . .2 � \ REPORT 00. : PD-11-88 PAGE 3 _______________________________________________________________________________ The subject site is designated "Special Purpose Commercial" within the Couctice Major Urban Area Plan and the Couctice West Neighbourhood Development Plan. Both plans are subject to Official Plan Amendment applications being OP& 87-81/0 and 3.2.I(7) . Within zoning By-law 84-63, as amended, of the Town of Newcastle, the subject site is currently zoned "Special Purpose Commercial (C5)11 and "Urban Residential Type One under a Holding designation ( (H)RI)". In accordance with approved policy, the subject applications were circulated to various agencies and departments for comment. The following is a summary of comments which have been received. Town of Newcastle Building Department '/0n objection." Town of Newcastle Public Works tmmot "We have reviewed the above-noted application and have no objection subject to the following comments: I. That all works are completed in accordance with the Town of Newcastle Design Criteria and 3tmudecd Drawings. 2. That the developer will bear the costs (1000) of any works along King Street/Highway 0o. 2 which are necessitated as a result of this development. 3. That the developer contribute to recovering onota for the construction of a sidewalk along King Street in accordance with Town Policy. 4. That the developer meet all the requirements of the Public Works Department, financial or otherwise. 5. That the Owner enter into a Site DIao Agreement with the Town and that this Department be kept informed of the ototoo of same at all times. All of the other standard requirements re: Lot Grading, Site Servicing, Schedules of Work, Performance Guarantees, Dnat Estimates, etc., should be included in the Development." Town of Newcastle Fire Department The Town of Newcastle Fire Department offered the following oonxneuta: "This Department would note an objection to this application. With the amount of development, which this municipality has and continues to realize, it is o great concern as to bmv this part-time department (4 full time firefighters) can continue to maintain the level of response, which is required to adequately protect this municipality. Should this project be approved, it is requested that no permits be issued until proper access routes are in place in accordance with Subsection 3.2.5.2(6) of the Ontario Building Code. As well, adequate water supplies for firefighting in accordance with Subsection 3.2.5.3 of the Ontario Building {ode should be in place. This project is a Group E occupancy as it is o mercantile building and moat therefore conform to Subsection 3.2.2.4 of the Building Code, dealing with the requirements for Group E occupancies of one and two storeys. As well' there is o Group F3 occupancy, being the gas bar (service station) , which must conform to Subsection 3.3.3.4(2) of the Building Code, as well as the Ontario Gasoline Handling Act." Region f Durham Planning tnxs t "In response to your correspondence, we vviob to advise that the above-noted proposal involving a retail commercial plaza is also the subject of an application to amend the Town of Newcastle Official Plan under our File: 0PA O7-8l/0. Accordingly, we will liaise with you during the processing of the Official Plan Amendment application. Also, we request that the amending by-law not be passed until the related official Plan amendment has been dealt with by both your Council and the Regional Council." Staff would further note that Regional Staff have requested the developer to undertake n retail analysis personate to Section 8.2.3.4 of the Regional Official Plan. At this time the retail analysis has not been completed.
