THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2003-188
being a by-law to establish the composition of the
Clarington Public Library Board and to repeal By-law 85-85
WHEREAS Section 9(1) of the Public Libraries Act, R.S.O. 1990, provides that a
public library board shall be composed of at least five members appointed by the
municipal councils;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF CLARINGTON ENACTS AS FOLLOWS:
1 . THAT the Clarington Public Library Board shall be composed of nine (9)
members.
2. THAT Council shall appoint two (2) of its members to serve on the
Clarington Public Library Board.
3. THAT the remaining seven (7) appointments be filled by residents of the
municipality who are qualified to be appointed in accordance with Section
10 (1) of the Public Libraries Act and who have submitted applications
seeking appointment pursuant to the publication of a public notice of
vacancies on the board published by the Municipal Clerk.
4. THAT, in accordance with Section 10 (3) of the Public Libraries Act, the
term of appointment shall be for a term concurrent with the term of the
appointing council, or until a successor is appointed, and a board member
may be reappointed for one or more further terms.
5. THAT, in accordance with Section 10 (4) of the Public Libraries Act, the
appointments shall be made at the first meeting of council in each term,
but if the council fails to make the appointments at its first meeting, it shall
do so at any regular or special meeting held within 60 days after its first
meeting.
6. THAT, in accordance with Section 14(1) of the Public Libraries Act, the
first meeting of the Board in a new term shall be called by the chief
executive officer appointed under Subsection 15(2) of the said Act.
7. THAT, in accordance with Section 24(1) of the Public Libraries Act, the
Clarington Public Library Board shall submit to the appointing council,
annually on or before the date and in the form specified by the council,
estimates of all sums required during the year for the purposes of the
board.
8. THAT By-law No. 85-85 is hereby repealed.
