RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-3-88 be received; and
2. THAT the Region of Durham be advised that the Town of Newcastle has no
objections to the approval of Plan of Condominium 18CDM-87-014.
BACKGROUND AND COMMENT:
On November 30, 1987, Planning Staff received a copy of an application filed with
the Region of Durham Planning Department by Dondeb Construction Limited for
consideration of a Plan of Condominium 18CDM-87-014.
As Committee may recall, the applicant has previously submitted and received the
appropriate approvals for Site Plan approval (File: DEV 86-75) and a Rezoning
application.

In consideration of the applicant's intentions to develop a condominium complex,
the Development Agreement between the Town and Dondeb Construction Limited
acknowledged the applicant's intentions of filing an application for the
registration of said lands under the provisions of the Condominium Act. To that
end, Staff would note that the Development Agreement, consistent with Town Policies
and the provisions of the Planning Act, incorporated additional provisions re; the
payment of cash-in-lieu of parkland. It was acknowledged within the Development
Agreement, that the necessary payment of cash-in-lieu of parkland would be
completed and satisfied prior to Staff's forwarding of a Clearance Letter to the
Town in respect of Condominium approval as deemed appropriate by Council.
Accordingly, Staff would have no objections to the recommendation of approval, in
consideration of the provisions contained within the Development Agreement.
