RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-2-88 be received; and
2. THAT the by-laws and schedules attached hereto be approved.
BACKGROUND AND COMMENT:
On November 9, 1987 the Planning Department received an application submitted by
Kingsberry Properties Limited requesting the removal of the " (H) Holding" symbol
provision on various parcels of land located within Part of Lot 35, Concession 2,
former Township of Darlington relating to Land Division Committee applications (see
attached) .
As Committee is, no doubt, aware the "Holding" symbol shall be removed upon Council
being satisfied that the uses to be permitted will be adequately serviced, the lands
to be used have adequate access, prior uses of the land will not prevent the use of
the land for the purposes intended by the by-law, that the lands and proposed uses
will be adequately protected from any physical or manmade hazards and conditions
associated with the lands, and that the agreements in respect of such matters and the
associated financial requirements, where required, have been executed with the Town
of Newcastle and/or the Regional Municipality of Durham.

As previously noted, the application as filed by Mr. Mack Foley on behalf of
Kiogobecry Properties, requested the removal of the "Holding" oyo0zoI from
various parcels of laud within Bart of Lot 35' Concession 3, former Township of
Darlington. These parcels were created by consent and as a condition of this
approval, the requirements of the Town of Newcastle had to be fulfilled. The
proposed lots are back Iota to be developed in oou 'ouotioo with Plan of
Subdivision 10M-781 (Remlack Holdings) . Staff would note that the conditions
as imposed tbrough the Laud Division Committee consideration of each
application have been satisfied to the Town's satisfaction with the exception
of the removal of the 0.3 Metre Reserve, where applicable, and the removal of
the "Holding" symbol affecting the parcel.
It is noted for the Committee's information that in respect of each /
application, the Region of Durham Planning Department and Works Department
provide individual comment to the Land Division Committee listing their various |

conditions of approval. It is anticipated that, notwithstanding the removal of �
the "Holding" ovndbnI, each application will require the clearance of the
appropriate conditions; be they financial or otherwise, before the Land Division �
Committee would consider the applications approved and finalize the necessary |

deed documents. |

In consideration of the above comments, Staff would have no objections to the

removal of the "Holding" ovoboI as ohuvmn on the attached by-law and schedules !
hereto. /
Staff would note for Committee's information that pursuant to Section 35 of the |

Planning Act, a by-law amendment to remove the (H) Holding symbol is not

being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle,
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Holding - Urban Residential Type One
((H)R1)" to "Urban Residential Type One (R1)" zone as shown on the attached
( Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 35 of the Planning Act.

NOTICE OF INTENTION TO PASS
AN AMENDING BY-LAW TO REMOVE
IN PART THE HOLDING SYMBOL
FROM LANDS ZONED BY BY-LAW 84-63
TAKE NOTICE that the Council of the Corporation of the Town of
Newcastle intends to pass an amending by-law under Section 35 of the
Planning Act to remove the holding provision from lands within Part of
Lot 35, Concession 2, former Township of Darlington (as shown below)
from "Holding - Urban Residential Type One ( (H)Rl)" to "Urban
Residential Type One (Rl) ".
The " (H)Rl" zone permits existing Residential and Conservation,
Forestry and Farm uses exclusive of livestock operation uses.
Removing the Holding symbol from the "(H)RZ" zone would permit the
development of twenty-two (22) urban residential lots.
The Council of the Corporation of the Town of Newcastle will consider
the proposed amending by-law not earlier than at its General Purpose
and Administration Committee meeting of January 18, 1988 and consider
passing a by-law not earlier than January 25, 1988.
ANY PERSON OR AGENCY REPRESENTATIVE may attend the Council meeting
at which the amending by-law is considered and/or make written or
verbal representation either in support of or in opposition to the
proposed by-law.
ADDITIONAL INFORMATION on the proposed amending by-law is available
amendment is available for inspection between 8:30 a.m. and 4:30
p.m. at the Planning Department, Municipal Offices, Hampton,
Ontario.
