SLBJECT: EXTENSION OF DRAFT APPROVAL
LUVERME INVESTMENTS LIMITED
PART LOT 14, CONCESSION 2, BOWMANVILLE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-33-86 be received; and
2. THAT Council adopt the following resolution:
"That Council of the Town of Newcastle hereby requests the Minister of
Municipal Affairs and Housing to extend the draft plan approval for
Subdivision 18T-76071 for a further one (1) year period to March 22, 1987". ;
and
3. THAT the request in Recommendation No.2 above be forwarded to the Ministry
of Municipal Affairs and Housing and Luverme Investments Limited be so
advised.
BACKGROUND AND COMMENT:
On January 17, 1986 Staff received a copy of a letter from the Ministry of Municipal
Affairs and Housing, addressed to Luverme Investments Limited (see attached) , noting
that the draft approval was to lapse on March 22, 1986. Staff would note for the
Committee' s information that, in respect of Plan of Subdivision 18T-76071, the

Subdivision Agreement pursuant to the requirements of draft approval , was
registered in the Registry Office, Registry Division of Newcastle, on
November 29, 1985 as Instrument No. 29997. Pursuant to the subdivision
agreement and in accordance with Section 5.10(20) of the Subdivision
Agreement, an Authorization to Commence Works was issued on December 3rd,
1985. It is Staff' s understanding that the intentions of Luverme
Investments Limited is to proceed with development in the spring of 1986,
weather permitting.
Accordingly and in consideration of the above, Staff would have no
objections to the approval of a further one (1) year extension in draft
approval for the Plan of Subdivision 18T-76071.

Subject: Lapsing of Draft Approval
Subdivision No. 16T- 76071
Municipality: Town of Newcastle
Dear Mr, Walker:
Draft approval of the above subdivision will lapse on
March 22, 1986 . If you are interested in pursuing
final approval please send us a request for draft
approval extension, with reasons in advance f the
lapsing date, with copies to the municipal and regional
planning departments. In order to identify any potential
problems I recommend that you also discuss the extension
with the municipal planning department.
By a copy of this letter we are asking the municipality
and the region to advise us of their position on your
recuest. If we do not hear from them we will assume
they have no objection. If there are any concerns with
the requested extension we will contact you in advance
of the lapsing. date.
Please remember that once draft approval has lapsed, it
cannot be reinstated. A new application would have to
be submitted to the Region of Durham.
