By-Law # MEETING: General Purpose and Administration Committee DATE: February 3rd, 1986 REPOT #: PD-32-86 FILE #: 18T-19720 SUBJECT: PROPOSED REVISIONS TO DRAFT APPROVED PLAN OF SUBDIVISION 18T-19720 FOSTER CREEK DEVELOPMENTS, NEWCASTLE VILLAGE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-32-86 be received; and 2. THAT the proposed revision to Draft Approved Plan of Subdivision 18T-19720 (copy * attached) , be approved and the Regional Municipality of Durham and the Ministry of Housing be so advised; and 3. THAT Staff prepare any necessary amendments to the Subdivision Agreement in respect of Plan 18T-19720 to give effect to the proposed revisions; and 4. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Town, said amendment pursuant to By-law 85-26, being a by-law to authorize execution of an agreement between Foster Creek Developments Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. BACKGROUND AND COMMENT: On December 18, 1985, the Planning Department received a request from Foster Creek Developments to modify Draft Approved Plan of Subdivision 18T-19720 in Newcastle Village to permit the construction of twenty-one (21) link dwellings. REPORT NO. : PD-32-86 Page 2 Staff note that, although link dwellings are detached above grade, they are connected below grade and therefore fall within the definition of a "semi- detached dwelling" in By-law 84-63. The subject subdivision is zoned "R-1" which permits the construction of semi-detached dwellings. The requested revisions involve the minor adjustment of lot lines in the Draft Approved Plan in order to obtain the lot frontages and areas required by By-law 84-63 for the construction of the link dwellings. A copy of the Plan showing the red-line revisions is attached to this Report. As well , the Subdivision Agreement between the Town and Foster Creek Developments requires modification to reflect the increase in Lot Development Charges for the twenty-one (21) lots. Staff have reviewed the proposed revision and are satisfied that the request complies with the intent of the Official Plan and the Neighbourhood Development Plan. It is therefore recommended that Council approve the proposed revision to the Draft Approved Plan and that the Regional Municipality of Durham and the Ministry of Housing be so advised. It is further recommended that Staff be authorized to prepare any necessary amendments to the Subdivision Agreement and that the Mayor and Clerk be authorized to execute the amendments to the Agreement on behalf of the Town.
