SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR THE MEETING OF
FEBRUARY 5, 1986
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-54-86 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
* prepared the attached list of applications to the Committee of Adjustment for the meeting
of February 5, 1986. This list includes the Pile number, applicant's name, site location,
type of variance requested, Official Plan Conformity, By-law Conformity, Staff' s comments
on the applications and the Committee of Adjustment' s decision.

APPLICATIONS:
A 1/86 - Castcar. Investments Ltd., Lot 29, Conc. . l , . Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an industrial building
leaving a rear yard of 1 m, instead of the required 7.5 m rear yard.
David McCrone appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Reicheld,
"THAT as the proposed variance does not appear to
offend the intent of the Official Plan or Zoning
By-law and would not appear to have a detrimental
effect on the surrounding properties, permission
is GRANTED to construct the industrial buildings
leaving a rear yard of 6.5 m. This decision is
conditional upon submission of a Site Plan to
the satisfaction of the Town."

Committee of Adjustment Meeting, February 5, 1986. . . . . .
A 3/86 - Ottavio & Clorinda Osso,. Lot 19, . Concession- 2, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a commercial building
with a rear yard of 5 m, instead of the required 10 m rear yard,
and allowing one loading space, instead of the required 2 spaces.
John Osso appeared in support of this application. Mr. Vandergaast,
Mr. Shorthouse, Mr. Pettit and Mr. Eeuwes appeared with interest
in the drainage over this lot. No other person appeared in support
of or in opposition to this application.
Moved by Mr. Barrie, seconded by Mr. Rehder,
"THAT as the proposed variance does not offend the
intent of the Official Plan or Zoning By-law or
have a detrimental effect on the surrounding
properties, the application is GRANTED to construct
a commercial building with a rear yard of 5 m and
one loading space. This approval is conditional
upon the property being graded to maintain the
natural drainage pattern off the adjoining
properties to the north. "

Moved by Mr. Murdoch, seconded by Mr. Rehder.
"THAT application No. A 2/86 be deferred to the
next meeting of the Committee of Adjustment at
the request of the applicant."

Moved by Mrs. Payne, seconded by Mr. Barrie,
"THAT Mr. T. Rehder be appointed as chairman
of the committee for this year."

Moved by Mrs. Payne, seconded by Mr. Reicheld,
"THAT the minutes of the last meeting be approved
as circulated."

Committee of Adjustment Meeting, February 5, 1986. . . . .
The request to review the decision making process of the committee was
noted and discussed at some length and was decided it would be most
appropriate to continue in the same manner.
Appeal date for the foregoing applications is March 7, 1986.
Next meeting of the Committee of Adjustment is March 5, 1986.
Meeting adjourned at 9:15 p.m.
