THAT Report PD-44-86 be received; and * 2. THAT the attached by-law, amending By-law 79-151 of the Town of Newcastle (Site Plan Control ) be approved. BACKGROUND AND COMMENT: Pursuant to the provisions of the Planning Act, the Town of Newcastle, in 1979, instituted a Site Plan Control By-law, By-law 79-151. As a result of the implementation of that by-law and in an effort to expedite development applications, the powers of Council , with respect to the approval of site plans and site plan agreements, were delegated jointly to the Director of Planning and the Director of Public Works by By-law 83-15. . . .2 REPORT NO. : PD-44-86 Page 2 With the recent resignation of the Director of Public Works and the possibility that, prior to hiring a replacement,it will be necessary to issue site plan approvals, it is deemed appropriate to further amend the Town' s Site Plan Control By-law to provide for the signing of site plans by a designate of the Directors involved. Accordingly, Staff have prepared an amendment to By-law 83-15 for the consideration of Council and would recommend its approval in order to ensure that there are no undue delays in the site plan approval process. February 4, 1986 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to amend By-law 83-15 of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle has adopted a by-law pursuant to the provisions of the Planning Act to delegate the powers of Council in respect of site plan approval; AND WHEREAS Council deems it appropriate to provide for the continuation of the site plan approval process in the absence of one of the designated officials; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle, enacts as follows: I. Paragraph 1 of By-law 83-15 is hereby amended by inserting the words "or their designates" following the words "Public Works" in the last line. 2. Paragraph 2 of By-law 83-15 is hereby amended by inserting the words "or their designates" following the words "Public Works" in the second line. CLERK MAYOR THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 83-15 being a By-law to Delegate the Powers of the Council of The Corporation of the Town of Newcastle under Subsection 10(b) of Section 40 of the Planning Act. WHEREAS Council has adopted a by-law pursuant to the provisions of Section 40 of the Planning Act; AND WHEREAS Council desires to utilize the provisions of Subsection 10(b) of Section 40 of the Planning Act; NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS AS FOLLOWS: 1. THE powers of the Council of The -Corporation of the Town of Newcastle under Subsection 10(b) of the said Section 40 are hereby i delegated jointly to the Director of Planning and the Director of Public Works of the Corporation of the Town of Newcastle. 2. UPON approval by the Director of Planning and the Director of Public Works, pursuant to paragraph l herein, the Mayor and Clerk of the Corporation of the Town of Newcastle are hereby authorized to execute any resulting Agreement on behalf of the Municipality, the consent of the Clerk being evidenced by his execution of such - Agreement or by written memorandum.
