SUB,JECT: ,PROPOSED SUBDIVISION AGREEMENT HURON TRAIL DEVELOPMENT GROUP LIMITED (FORMERLY OAKLAND DEVELOPMENTS) PLAN OF SUBDIVISION 18T-240.02 t RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-40-86 be received; and 2. THAT;the attached by-law, authoeizing execution of a Subdivision Agreement between Huron Trail Development Group Limited and the Corporation of the Town of Newcastle be approved; and 3. THAT 'the Mayor and Clerk be authorized to execute the Subdivision Agreement between Huron Trail Development Group Limited and. the Town of Newcastle at such time as an agreement has been finalized to .the satisfaction of the Director of Public Works and the Director of Planning. BACKGROUND AND COMMENT: Staff would .note for the Committee' s i0ormation' that at the General Purpose and Administration Committee meeting of November 18, 1985 the recommendations within Report PD-175-85 were approved and forwarded to Council for consideration. The recommendations within said report were as follows: . . .2 REPORT NO. : PD-40-86 Page 2 "THAT Report .PD-175-85-be received.; and THAT the attached by-law authorizing execution of a Subdivision Agreement between Oakland Developments Limited and the Corporation of the Town of Newcastle be approved; and THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between Oakland Developments Limited and the Town of Newcastle. Staff would note for the Committee' s information that, by letter dated * Janwary 22, 1986 (see *attached) o Staff were advised that the above-noted development had changed ownership. Accordingly a request was made of Staff to initiate the appropriate amending by-law to enable Huron Trail Developments to enterinto the Subdivision Agreement with the Town of Newcastle. In order to facilitate execution of the agreement with the new Owners, an * auth.orizing by-law, as attached hereto, is submitted for Committee's consideration. Therefore, would you initiate the appropriate amending By-Law to enable Huron Trail to enter into a Subdivision Agreement with the Town of Newcastle at your earliest convenience, as they would like to have the Plan of Subdivision registered in March. Creamer BCi er THE CORPORATION Of THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to authorize the entering into of an Agreement with Huron Trail Development Group Limited and the Corporation of the Town of Newcastle. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal , an Agreement between Huron Trail Development Group Limited and the said Corporation dated the day of 1986, in the form attached hereto as Schedule 2. THAT Schedule "V attached hereto forms part of this by-)aw.
