Subject: BY-LAW ENFORCEMENT DURING SANTA CLAUS PARADE AND OTHER RELATED
ISSUES
Recommendations:
The following is respectfully recommended to Council:
1. THAT Report PD-259-91 be received for information.
1. BACKGROUND:
At the November 18, 1991 General Purpose and Administration
Committee meeting, Committee raised the following issues
related to the Santa Claus Parade:
a) parking metres not bagged;
b) no enforcement of Hawker Pedlars By-law
C) cash at By-law office not locked
2. COMMENTS
2 . 1 On the issue of parking metres not bagged before the Santa
Claus Parade, Staff did not receive any request prior to the
parade. It was therefore assumed that Public Works Department
will advise the Staff at By-law Division to bag the parking
metres as they processed the Road Occupancy Permit.
Unfortunately, there was no direction from Public Works
Department. Be it as it may, Staff at By-law Division have
the responsibility to bag the parking metres regardless of
whether of not request or direction is received. The staff
responsible have been instructed to take corrective measures,
be proactive rather than reactive.

2 . 2 On this issue of enforcement of the Hawker Pedlar By-law,
there was no request from the organizer of the parade for by-
law enforcement nor were there any complaints received prior
to the parade. It should be noted that the Town By-law
officers have never enforced this By-law at Santa Claus Parade
and Staff obviously did not anticipate that this could be a
problem. To rectify this problem, Staff propose that this
matter be addressed in the 1992 Budget to have certain amount
of funds set aside for overtime works for the Santa Claus
Parade and other similar functions. It should be noted that
Durham Police was present at the parade and could have been
called upon to enforce the by-law.
2 . 3 The cash that was identified in the Parking Officer's office
amounts to $121. 50 in quarters stored in a plastic bag inside
the office. There is no locking filing cabinet or locking
desk drawer inside the office. However, the office is always
locked when the officers are out on patrol. Nevertheless, the
officers should have deposited the money to Treasury
Department before the end of the day despite the fact that the
money is kept in a locked office. This procedural change has
now been implemented.
