Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT addendum to Report PD-235-91 be received;
2 . THAT the Region of Durham be requested to amend the
existing Durham Region Official Plan (1976) and
redesignate the Hamlet of Solina from a "Hamlet for
Infill" to a "Hamlet for Growth" .
3 . THAT the applicant, the Region of Durham, delegations
and persons listed in this report, be notified of
Council's decision.
1. On October 7, 1991, a report recommending denial of the
application was presented to the General Purpose and
Administration Committee. A copy of Report PD-235-91 is
attached.
2 . On October 15, 1991, the Council of the Town of Newcastle
approved Recommendation #GPA-633-91:
"THAT Official Plan Amendment Application 89-42/D/N,
Subdivision Application 18T-89038, and Rezoning Application
DEV 89-55 submitted by 821010 Ontario Limited be referred
back to staff for the preparation of the necessary
documentation and brought back to Council for final
approval. "

3 . Section 27 of the Planning Act, states that all amendments
to local official plans must conform to the official plan of
the upper tier municipality. In the case of the Town of
Newcastle, no amendment can be made to the Town's Official
Plan which is contrary to the Region of Durham's Official
Plan.
4 . Prior to the revision of the Regional Municipality of Durham
Act on June 27, 1991, the Town of Newcastle provided
recommendations to the Region which adopted the amendment by
by-law. Under the revised procedure, where both the
Regional and local Official Plans are affected by a proposed
amendment, the Town must await a revision to the Durham
Region Official Plan prior to adopting the by-law to amend
the Town of Newcastle Official Plan.
5. With regard to the application by 821010 Ontario Limited
(Westlake) , an amendment to the Town's Official Plan to
redesignate the Hamlet of Solina from a "Hamlet for
Infilling" to a "Hamlet for Growth" , and to designate
additional "Residential Expansion" lands, would not be
approved because the current Regional Official Plan (1976)
designates Solina as a "Hamlet for Infill. "
6. In order to proceed to amend the Town's Official Plan, it. is
necessary to request the Region of Durham to amend its
Official Plan. Consequently, Staff cannot implement
Council's directive as noted above, until the Regional
Official Plan is amended. Planning Staff will bring back
the necessary documentation for final approval when the
Regional Official Plan has been amended.
