Subject: REMOVAL OF "HOLDING (H) " SYMBOL
APPLICANT: WOLFGANG HRYCIUK AND CYNTHIA SAVAGE

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-230-91 be received;
2 . THAT the rezoning application submitted by Wolfgang Hryciuk and
Cynthia Savage, requesting the removal of the "Holding (H) "
symbol from the subject lands within Part Lot 14, Concession 8,
former Township of Darlington be APPROVED and the attached by-
law forwarded to Council for approval; and
3 . THAT the applicant and any delegation be advised of Committee and
Council's decision.
1. BACKGROUND:
1. 1 On January 29, 1990, the Council of the Corporation of the Town
of Newcastle resolved to recommend to Regional Council approval
of a proposed amendment to the Haydon Secondary Plan. The
proposed amendment would expand the limits of the Haydon
Secondary Plan and permit the creation of four (4) Hamlet
residential lots. In addition, on January 29, 1990, the Town
Council also resolved to pass an amending by-law at such time as
the amendment to the Haydon Secondary Plan had been approved by
Regional Council.
1.2 Regional Council resolved, on May 16, 1991, to request the
Ministry of Municipal Affairs to approve the proposed amendment
to the Haydon Secondary Plan. Subsequently, an amending by-law
was passed by Town Council on June 25, 1990 zoning the subject
property "Holding - Residential Hamlet ( (H)RH) II .

1. 3 The applicant has submitted an application requesting the removal
of the Holding symbol in order to finalize the related consent
applications.
2. COMMENTS:
2 . 1 Prior to the removal of the "Holding (H) " symbol, Council must be
satisfied that the use or uses to be permitted will be adequately
serviced, have adequate access and will be utilized in accordance
with the Town's Comprehensive Zoning By-law. In addition, the
amendment to the Haydon Secondary Plan must receive approval from
the Minister of Municipal Affairs. Staff wish to advise that the
above conditions have now been met and therefore, the "Holding"
symbol can now be removed.
2 . 2 It is noted that the conditions of the Town will be imposed
through the related consent applications.
2 . 3 Pursuant to Section 35 of the Planning Act, a by-law amendment to
remove the "Holding" symbol is not subject to the normal appeal
period afforded to a standard rezoning application and
accordingly, shall be deemed final and binding should Council
grant approval.
2 .4 In consideration of the comments noted above, Staff would have no
objection to the removal of the "Holding (H) " symbol as shown on
the attached by-law and schedule.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 91-
,being a By-law to amend By-law 84-63, the Comprehensive zoning By-
law for the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle in accordance with application
DEV 87-56 to implement the creation of four (4) Hamlet residential
lots through the consent process.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Schedule "11" to By-law 84-63 as amended, is hereby further
amended by changing the zone designation from:
"Holding - Residential Hamlet ( (H)Rh)" to "Residential Hamlet (RH) "
2. Schedule "A" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of the passing
hereof, subject to the provisions of Section 35 of the Planning
Act.
