THAT Report PD-211-91 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Michael Gimblett on behalf of Ross Brown, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council 's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Michael Gimblett 1 .2 Owner: Ross Brown 1. 3 Rezoning: From "Agricultural Exception A-111 to a zone appropriate to permit the creation of two (2) residential lots . 1 .4 Area: 0 . 32 hectares 2 LOCATION 2 . 1 The subject lands are located within Part of Lot 9, Concession 2 in the former Township of Clarke. The municipal address of the property is 2139 Regional Road #18 in the Hamlet of Newtonville. 3 BACKGROUND 3 . 1 On May 13, 1991, a letter from Mr. Gimblett was received 2 REPORT NO. PD-211-91 PAGE 2 requesting that the applications for subdivision (18T88099 ) and official plan amendment (89-001/D/N) on these lands be closed and that the existing rezoning application be revised to reflect the creation of 2 residential lots. J 3.2 In 1988, the applicant submitted applications to permit 29 residential lots and a commercial block with 1850 square metres of floor area. These applicants being, DEV 88-134, 18TB8099 and 89-001/D/N, where dealt with by Staff and Council . The applicant has since notified the Town that they wish to withdraw the subdivision and official plan amendment applications ( 18T88099 and 89-001/D/N) , and revise the rezoning application (DEV 88- 134) . 3 . 3 An application has been made to the Land Division Committee to create these two lots . This Committee approved this application on July 8, 1991 . The conditions of Land Division including approval of the rezoning application, must be met by July 17, 1992 . 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: Single Family Dwelling and pasture 4 .2 Surrounding Uses: East - Existing Residential West - Farmland South - Existing Residential and farmland North - Farmland and a single dwelling unit 5 OFFICIAL PLAN POLICIES 5 . 1 Within the Durham Region Official Plans, the lands are designated "Hamlet" . Lands so designated are primarily used for residential purposes . 5 .2 The Town of Newcastle Official Plan designates the lands as "Residential Expansion" within the Hamlet of Newtonville. PD-211-91 PAGE 3 so designated shall be used for residential purposes provided the appropriate approvals for private services are obtained from the Health Unit and Ministry of the Environment. 6 ZONING BY-LAW PROVISIONS 6 . 1 According to the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, the land is zoned "Residential Hamlet (RH) " and "Agricultural Exception (A-1) " . The "Residential Hamlet" zone allows single dwelling units. The "Agricultural Exception (A-1) " zone also permits single dwelling units . Although the proposed use is permitted in both zones, the lot frontage, area and yard requirements must comply thus the application to amend the zoning by-law. 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council 's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands . In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 8 AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Durham Region Health Unit Ganaraska Conservation Authority Ministry of Natural Resources 8 .2 The Town of Newcastle Community Services Department has requested that 5% cash-in-lieu of parkland be paid by the applicant/owner. 8 . 3 The Town of Newcastle Public Works Department request that any r �; . . . .4 i REPORT NO. PD-211-91 PAGE 4 easements required be granted to the Town free and clear of any encumbrances, that a lot grading plan be submitted to the satisfaction of the Works Department, and that all works are completed in accordance with the Town of Newcastle's Design Guidelines and Standard Drawings . 8 .4 Comments have yet to be received from Durham Region Planning Department, Durham Region Works Department, the Ministry of the Environment and Ontario Hydro. 9 STAFF COMMENTS 9 . 1 Staff note that the Region must be notified by the applicant that they wish to withdraw the subdivision and official plan amendment applications inasmuch as these are Regional applications . Until the Town of Newcastle receives notification from the Region that these applications have been withdrawn, Town Staff can not take a recommendation report for Council's consideration. 10 CONCLUSION 10. 1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff to indicate issues or areas of concern regarding the subject application. It is recommended the application be referred back to Staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments and required revisions .
